Hello VJ community,

First of all, I want to say thank you for all of the positive energy and moral support I have found on this site. I am not the type to complain or ask every question that comes to my mind, but I visit this site every single day and I am always impressed and humbled by the spirit of all of those who are handling the ups and downs of this process together.

My question is about the I-134 supporting documentation. We are eagerly awaiting our NOA2 (NOA1 date was August 6, 2012) and preparing ourselves for the next step. My income is above the 125% threshold, but just barely and not for long (I am a recent university graduate and my income history is very limited). I don't want to take any chances, so we will be using a co-sponsor, whose income and assets are more than enough to cover all necessary bases. Our co-sponsor is retired, however, and therefore proving "employment" seems more difficult.

1) Does our co-sponsor still need an employment letter?

2) Should their I-134 "type of business" indicate that they are retired (ex. "TEACHER (RETIRED)")

3) The I-134 requires documentation of income, but what about assets (real estate, investments, etc.)? - They don't seem to ask for proof, just to list them.

4) What is the proper way to submit my documents and the co-sponsors documents?

Thank you, and best wishes to everyone, keep up the positive energy!

Ryan

My first question to you would be simple. Does the Belarus embassy/consulate accept Affidavits of Support at the K-1 level. A lot of countries are not, but sometimes make exceptions for students.

My fiancée is a citizen of Belarus, but the embassy she will apply to/interview at is in Moscow (if I am wrong about that, hopefully someone else with experience regarding Belarus/Russia can chime in).

This is from the website of the U.S. embassy in Moscow:

Documents Needed for Fiancé(e)s

.

.

.

  • Financial documents from a US citizen petitioner:
    • Copy of original, signed tax returns for the last year (both W-2 and 1040). If copies of tax returns are unavailable, provide transcripts from the IRS.
    • Form I-134 (Affidavit of Support)
    • Bank statements
    • Employment letter

If you meet poverty Guidelines within the last year, you don't need a person to assist in the fiancials. Just provide your most recent 1040 and w-2's.

You can highlight to the CO via documentation your fiancee will provide that you are a university student, and while you meet the guidelines you will be making more upon graduation.

CO's tend to grown on Affidavits at the K-1 level due to the fact the document is not legally binding and the intending immigrant can still possibly become a burden on society.

Sorry for the run around, but with that being said, if you are making enough, just say one year and you should be fine honestly. The 2-3 year deal is overkill and is not needed if you can substansiate via w-2's, paystubs, 1040, etc.

Good luck on your Journey and remain positive!

Thank you very much, I appreciate your advice.

I'm wondering what you mean about consulates not accepting or frowning upon Affidavits of Support - isn't this a specifically required document?

Sorry, it's earlier than I'm used to being up with a corporate transition. I meant Co-sponsors in regards to affidavits of support. My apologies.

Ahh, okay. Maybe someone else can help to answer that - does the U.S. embassy in Moscow accept co-sponsors for the I-134?

I thought Belarus went to Warsaw, Poland embassy and not to Russia.

Here's some info I found regarding it:

http://www.visapro.com/Immigration-Articles/?a=468&z=36

Be sure to specify that the approved petition should be sent to Warsaw if your fiancée is in Belarus, Latvia, Lithuania, or Poland. The U.S. Embassies in Belarus, Latvia , and Lithuania do not process fiancée visas. If your petition has been misdirected to Minsk, Riga, or Vilnius it will take several weeks before it reaches Warsaw. You do not need to contact the U.S. Embassies in Minsk, Riga, or Vilnius regarding a misdirected petition. They will automatically forward the petition to Warsaw via registered diplomatic pouch. If, however, your petition has been sent in error to Moscow or to another Foreign Service post, you should contact that post and ask them to forward the petition to Warsaw. You do not need to contact the U.S. Embassy in Warsaw with a request to retrieve your petition from another Embassy.

Oh boy. How could I have missed that? She has gone to the embassy in Moscow for her C1/D visas in the past (necessary for her work on a cruise ship, where we met), so we were sure from the start that it should be Moscow.

Now both of our hearts are beating much faster, please help - how do we correct this mistake? Her petition has been at the CSC now since August 3.
