Saylin I was referred to you, as you are the resident expert. I am at the point of feeling quite upset because I cant get my head around the NVC process. The more I read the worse it gets...

below is my original post:

Im confused - I used to think I was getting good at this whole process but no! I have been reading the forums daily, learning heaps, discovering who the gurus are - Darnell rocks! I have been enjoying others triumphs, saddened by others heartbreaks and learning about trolls (amazing who knew there were such bored and nasty fools out there...)

About me and mine:

I am in Australia with my family - I am the intending immigrant, my husband and child are both dual US and Aus citizens

Hubby has been in Aus 27 years. When researching immigration on this site I discovered my husband should have been filing taxes with the IRS for 27 years - who knew, we sure didnt. Discovering he was out of compliance with US law was a shock for my law abiding husband. Time for the fun to begin.

Hubby filed 3 years of taxes (via Offshore Voluntry Disclosure Program)I did all the paperwork and found it very difficult and complicated. Just comprehending the instructions was difficult due to US speak (We just communicate a little bit differently down here). Aus and US have different tax periods so we had to do lots of calculations and conversions. We couldnt understand how to complete a required process so decided a US tax consultant might have to do our paperwork instead. In checking our paperwork we were advised all was ok 'just dot these t's and dot those i's' so he signed off on our package and we mailed it off. I was feeling quite chuffed with myself for that success.

Then we completed and sent of the I130 and received our NOA2 in 66 days. Again I was feeling quite chuffed with myself for that success.

Sent tax transcript request to IRS.

Researched NVC process - hmmmmmm. Filled in DS 3032 and DS 230 (fun things to do while you wait for new content on Visa Journey)I have them on the table glaring accusingly at me as I type...

Hubby received AOS and my 'Immigrant Letter?' which contains NVC case numer, Invoice ID number, and my Beneficiary ID number from NVC VIA EMAIL

We have just received the the Tax Transcripts from the IRS so are ready to proceed. Hooray hubby is now in compliance with IRS (no longer a crimminal)

Notes:

We DO want to get to US ASAP - unusual huh

We DO Not have a US BANK ACCOUNT - Hubby has been in Aus half his life and we didnt think to open one when in us on hol's last year - dumb huh

Hubby does have an SSN

We DO have a joint sponser USC - Hubby's BIL - We will be staying with him upon arrival in US

AUS income WILL NOT continue after US entry - Hubby will need to find US employment

We are about to put our home on the market and expect it will sell quickly (our suburb is HOT at the moment)Yeah for us we will have money in the bank to purchase US home

Things that are racing through my head - And I need expert advise - Darnell, Ryan, Penquin are you there? (sorry if i missed an expert or two)

1)Do I snail mail or email DS 230 to NVC (I have indicated - no agent, comunicate with me)

2)Should I cut bar code off email and put on my pre-filled copy of the DS 230 (which one is the bar code, it looks like there is TWO)

3)Should I even send the DS 230

4)AOS and other payments to NVC - Can USC BIL pay these as we cant do electronic filing, if so how?

I think I have over researched this process and read too much erronous information - I can no longer see the woods for the trees - so to speak

I will probably have more silly questions as we go along

One thing I can tell you FOR SURE is that the AOS and IV bill HAVE to be paid through a US bank account. Everything I have read says so. Does your husband have a family member or close friend who can pay it from their account and he can wire them the money?

I would DEFINITELY email the DS 230 if you havent already. And as far as I can tell you only need the barcoded cover sheets that come after paying the bill. One for each packet (AOS and IV).

Have you checked out the guides? IE: http://www.visajourney.com/wiki/index.php/How_to_bring_your_foreign_spouse_to_live_in_the_US

Im sure you have but just checking!

Whoops! Confused my 230 and 3032.

The Choice of Agent is the DS3032. This should be emailed as soon as you have your case number from the NVC.

The DS230 is in the IV packet, which will have a cover sheet with a barcode on it after you pay the 230 bill online.

Makes.. sense?

1)Do I snail mail or email DS 230 to NVC (I have indicated - no agent, comunicate with me)

You mean DS 3032, yes? Email it. The right format is here: http://www.visajourney.com/wiki/index.php/Email_DS-3032_form you'll know it's been accepted when your IV bill appears to be paid.

2)Should I cut bar code off email and put on my pre-filled copy of the DS 230 (which one is the bar code, it looks like there is TWO)

I haven't gotten to NVC yet, so I'm not sure what you mean here. What I know is that once you've paid the IV bill you'll get a barcode sheet that you print out and then attach to the DS 230 and all the rest of your civil documents.

3)Should I even send the DS 230

Not if you haven't paid your IV bill yet...unless you mean DS 3032 Choice of Agent? If so, then yes, send DS 3032 asap.

4)AOS and other payments to NVC - Can USC BIL pay these as we cant do electronic filing, if so how?

Yes he can, just give him the login information and he can login to the portal and pay the fees. I think you can also pay these fees using an American credit card.

Good Luck!

Hi Austomass

I am Australian also and going through the same thing as you... I think we are slightly ahead of where you are. It is very confusing and you just have to do everything they tell you to do.

Yes you have to file the DS 230, we sent it snail mail....we did it in the USA (which we were there on holidays over this Christmas/New Year) and we filed the I-864 via snail mail over there. Boy this is such a long trek but it will be worth it in the end.

If you want to contact me please let me know and i can talk you through what we have done and what you have to do. The key thing is do everything they want because all you have to do is get an upstart and you won't get your green card.

Hopefully we are just about at interview stage.... it is hard to prove domicile but just think of every little thing your husband has over there and add it to the i-864.

If you do want to contact me please let me know and we can chat.

Yeah I think this site also gets a tad confusing because sometimes its called the IV bill or IV packet, which is the DS-230 form.

So I try to stop calling it the form numbers. IE, the AOS, not the I-864.

My Kiwi husband gets cross eyed when I even try to explain to him all the stuff Im doing and researching in regards to the visa. :P

based on what's in post #1:

--primary sponser on the I-864 must to show proof of re-establishing domicile - can be show on interview day, so you have some time

--unless primary sponser has landed a job in the usa and has paystubs to show current annual income, get a co-sponser

Other than that, I think you've got the rest of it covered.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
