I am looking for easy to understand requirement for my fiance to get a visa so we can get married. My fiance is Mexican and I am US citizen. She applied for a tourist visa approx. 1 year ago and was denied. She was also applying for her kids as well at the time. She is divorced. The reason she used was to visit the US and go shopping. Any tips on getting approved or why she was denied?

What is the easiest way for us to get married either in Mexico or the US to make this happen? Is K1 visa the best choice? some of what I have read on requirements does not make any sense such as having a bank account together. I need to get her in the US to do many of these things. Frustrated...please help.

The only requirements for the k1 visa is that you are both free to marry and have met in person within the past 2 years.

Maybe someone can weigh in but the way I understand it is they look at everyone as immigrant intent, and the fact that she wanted to bring her kids with her took away the strong ties and reason for her to go back home. I can't comment on K-1 because I got married overseas and went CR-1

CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

She wont get a tourist visa unless she complies with the strongest ties rule. Very difficult to do and near impossible if she tried to bring her kids at the same time. Shopping? That has been tried 10 million times. Any attempt to lie or defraud the U S govt is never a good idea.

Marry where you want or where you can and then file for a C R 1 visa. K 1 is fiancee visa so she must enter USA and marry within 90 days.

You are wrong about the inital need for joint bank account. This can be part of what you will do later.

Make sure you understand exactly what is required to obtain visas for the kids you speak of. This may determine what course of action you want to take. Get info directly from the U S embassy that you will use later. This is a serious subject the requires the correct understanding.

Tourist visas are not that easy to obtain. You must prove strong ties to Mexico and give the interviewing officer no doubt at all that you will return to Mexico. The tourist visa denial will not have any effect on getting a fiance(e) or spousal visa.

The K-1 does not require having any joint accounts until later, after you are married and filing for adjustment of status. You just need to file the I-129F petition with all the required documents, proving you are both free to marry and have met in person within the 2 years prior to filing. After the petition is approved, she would have an interview in Juarez. If the visa is approved, you will have 90 days to marry once she enters the US with the K-1 visa. You need to do some research. There are guides, FAQs and forums here on VJ. I suggest you read through everything you can in order to get a better understanding of what is required and the steps you need to go through for the K-1.
