Ok so we had our interview today. Everything was going well until they asked my fiance to sign the form and print my name. He made the mistake of saying out loud that he always gets confused with how to spell my last name. So the CO got kind of huffy and started to take the form back and was like how long have you been together and you don't know her last name. He was like no I know her last name and he said it I just get mixed up sometimes about the spelling because I never write her last name. So we get past that and are back on track. So she then starts to ask me questions, she asks me how many times I have been divorced and I tell her. She then ask do I have any other children as our daughter was with us. I tell her yes I also have two sons. So then she asks me about my job and I tell her that I am not working right now as I have been in the DR with my fiance. As she is looking at my passport she is like you travel back and forth alot, were do you work at. And I stated again I am not currently working and that is why I am able to do so but for the most part I have been staying in the DR and traveling to the US when possible. She then says I mean there is nothing wrong with that I mean I am just curious as to how you are paying for this, are you using credit cards or something. I said sometimes or my mom pays for it. So then she says ok, now I need to speak with him. So she then asks him some of the same questions she asked me. Then when she asked him how many children do I have he told her 3. So she then states she just told me she has 2, and he corrected her and was like you asked her how many other children she has and she said two sons and we have a daughter so that makes 3. She said ok and asked the names and ages. She then asked him were I worked and he told her that I use to work at the hospital and when she asked which one he was like I don't know the name. So I said to her I have not worked there since 2 months into us dating so no I did not talk about it much, so no I am sure he would not remember as I am no longer there. She then starts to asks more questions about our daughter and why his name was not on the birth certificate and I explained that because he was not there and we are not married I could not put his name on it but we have since filed for it to be added with the affidavit of parentage. Now he is starting to get nervous so I am telling him to just calm down and listen to what she is asking him, and she tells him to give me our daughter and for me to wait outside so she can finish talking to him. When he came out he said the only other question she asked him was did he help pay for my trips since I was back and forth so often and he said no. We go back and sit down and wait. We are then called to the fraud prevention unit. A nice gentleman takes my fiance into the room, but before he closes the door he asked me was this our daughter and I stated. He asks me about the birth certificate and I tell him the same information and show him the copies of the notarized affidavit and he is like ok that is fine. My fiance is only in the room for a minute and when he comes out he said the entire time the gentleman is talking with the CO that sent us to him and is asking her what is the problem why did she send us to him, we have a child together and the fact that he missed a letter in my last name is not reason to send us to him, and if she did not feel that this was really our child together then we could have a DNA test done right then and there. He then asked my fiance if he would agree to that and he was like yes and the gentleman said ok we can do this right here and now and be done with it. He never asked to speak with me and just sent us out to wait. About 10 mins later the CO calls us back to here window and gives us a green slip with is passport and was like someone would call him with information on what may need to be brought back and that maybe I might have our daughters BC with his name on it at that time as well. But that she needed to look at our case file a little bit more so she was putting us in AP. The green slip that she gave us stated that another interview date would be send to my email address, the other thing that was checked was 221(g) and that we are in AP. I would also like to add that as we were sitting there waiting through all of this and to go to window 13 we seen that this particular CO was sending just about everyone to the fraud unit (the reason we knew this was because we had been called to rm 13 so we knew what it was when they were calling other people we watched come from her window). So VJ what do you think? I have faith that we will be approved I am just a little upset at the not knowing and more waiting. :crying:

Did they take the DNA? Because if they did, I don't see why you would need his name on the birth certificate. If they take it then his passport should be ready. If I were you I will call them and ask about that.

Honestly, I think you will be fine. You both held up well under all the scrutiny and uncertainty. Unfortunately, this is how that system works! Welcome to the interview with fraud prevention club! I've been there and conquered it, so hang in there and fight til the very end...

Thank you!!! I just hate the not knowing. And to be honest the CO seemed to be more concerned with how I was financially able to travel back and forth so often not if we had a real relationship. Go figure.

Nope the CO did not want to do it even after the fraud prevention unit gentleman told her to do so if she really felt our daughter was not his and my fiance agreed to it in front of her. She did not even want the rest of the evidence of updated pics and phone records or anything. She just stated that she wanted to look through our case file again, and I am thinking to myself hell the case file has been here since the end of Oct. and you never looked through it before and if so what is going to be different now? Also if the fraud prevention unit did not feel that there was any fraud what is the problem. Sigh...more unknown waiting. :girlwerewolf2xn::ranting:

Nope the CO did not want to do it even after the fraud prevention unit gentleman told her to do so if she really felt our daughter was not his and my fiance agreed to it in front of her. She did not even want the rest of the evidence of updated pics and phone records or anything. She just stated that she wanted to look through our case file again, and I am thinking to myself hell the case file has been here since the end of Oct. and you never looked through it before and if so what is going to be different now? Also if the fraud prevention unit did not feel that there was any fraud what is the problem. Sigh...more unknown waiting. :girlwerewolf2xn::ranting:

Everyone make mistakes, I mean no relationship is perfect so I don't see why they make it such a big deal. They could have asked intimate questions but instead they're just miserable and want to make you wait more. They defitenely have to take a DNA if they are saying or doubting that your daughter is not his.. It doesn't depend on your relationship. It depends on the person you get during the interview. Now it's time to keep calling non stop and find out what are your options. Also look for any immigration attorneys around the consulate. I have read on here of one that is very helfpul with these kinds of situation, especially if your case is still in DR. Best of luck!!

Hey sorry that you guys were put through this but, in my personal opinion I don't think it should be a problem from what you state to her the issue wasn't about him spelling you last name wrong cause we are all human and we do make mistake, I think the fact of the matter to her is why if that is his daughter is name isn't on the BC?? My question is was your daughter born in the states or in DR? Did you take the papers that you filed for his name to get added? I believe that if you can fix this issue of adding his name to the birth cert ASAP your cause would be approved. What made her question you guys more was the fact that she was trying to change him in a mix up about how many kids you have. It doesn't sound that bad... I just suggest you fix the BC issue to show the more "proof" and if you are currently living out there with him that states alot.

Yes, she was born in the US and I showed her the info were I was having him added and told her they informed me it could take 6+ months to do so. I have been living here with him for the past 3 years. I just go back to the US ever few month my son was even in school here until last year and all of this is in my file so again what she is looking for who knows. I even had the first ultra sounds and letters from doc when we first found out I was pregnant at 6 weeks from doc in the DR. She didnt even ask about the pics of me and him, our children together none of that.

This to me is a red flag. You don't need the dad to be there to put his name on the certificate nor you have to marry to put his name there. Honestly your case should be OK. If I were you I would do the DNA test now just in case.

Also if you don't meet the income requirement they might deny your application hence why she asked you many times where did you get the money to buy the tickets.

Not sure what country you are from but in the US you absolutely CAN NOT add the father's name to the BC unless he is there to show ID and sign the form OR you are married(which neither was possible in my case). So there is no red flag there as it is not possible. And we did agree to the DNA test and thought they were going to give us one after it was suggested and we were told by the fraud unit officer that is what was going to be done, yet the CO just decided to put us in AP and said she wanted to look over the file. Not to mention, even outside of us having a child together we were together a year before that and have evidence of the relationship so this is why I am at a loss.

Now as far as the income requirements, they actually did not even ask for the paper work as the gentleman that took our papers said that they didn't really use it for the K-1 but I gave it to him anyway and I have a co-sponsor that makes well above the poverty limits. I know of others that have went through the Embassy in the DR that told me the same thing, and that is that they did not/were not asked for the affidavit of support info for the k-1. So nope, the income was not the issue or she would have asked for some more evidence or something. But nothing, she asked for nothing. Just that she may call for something at a later time.

Again, it is the not knowing that is hard because I don't know what I can do to help the process along because she didn't say bring this in lieu of this or that. But we are staying positive because she did not say denied.

Sorry to hear your situation. I believe you will be ok. Since you are currently living with your husband and family in DR, there is no stress in the wait I guess. It will just be a matter of time until he is approved.

Sorry to hear your situation. I believe you will be ok. Since you are currently living with your husband and family in DR, there is no stress in the wait I guess. It will just be a matter of time until he is approved.

I actually somewhat agree with the above quote. When you have the baby at a hospital in the US, NJ to be more accurate, and the father is not present you just have to inform them what the first and last name of father is and then last name will be given to the baby. However, the name of the father will not appear. Odd but I'm a witness to it.

Thanks, that is how I am looking at it. It is the same in Michigan were I had her. She has his last name, they do not care what name you give as a last name. His name is just not on there as of yet.

I'm surprised that they didn't talk to you about the income requirements.

Normally, you have to have an income, even basic and if you don't meet the requirement you need a co-sponsor. The co-sponsor can't be the only sponsor.

But maybe I missed something...It's late

In the DR you can have a co-sponsor without combined income from the petitioner. The gentleman that was taking our paper work even stated they don't normally even ask for the affidavit of support information although I gave it to him any.

You should be fine. Don't think of any other issue (DNA, affidavit, etc). Just relax and pray. :)
