BOISE, Idaho (Reuters) - Pregnant mothers caught using illegal drugs could go to prison for endangering their unborn children under a bill passed by the Idaho State Senate on Tuesday.

[...]

If the measure passes the Idaho House and receives the approval of Idaho Gov. Dirk Kempthorne, a Republican, the measure would be the first in the United States specifically to make it a crime for a pregnant woman to use illegal drugs.

If caught, individuals could first face drug treatment or drug court. Beyond that, however, judges have the option of sending mothers to jail for up to five years or imposing a $50,000 fine.

For drug use while pregnant?

no..for drug usage prior to giving birth...or right after baby's born...

use to be an automatic hotline to dfs...and charges were filed...

i had at one time,. 4 mothers who children were taken from them and they were court ordered to go to therapy for chemical dependence issues due to this...

Yeah, thought illegal drug use was always an arrestable offense with possible jail time. What is printed below (and linked) reads to be about what it is now without new law. Do they just like passing laws, even ones that are redunant to make it look like they are busy working?

I think this is just one more law to establish that the unborn is protected under the law just like the born. Think about the potential consequences. It's not that they ain't busy. It's that this is one of the many avenues being pursued towards the same goal...

Ok, I but that reasoning of why they are pushing it.. Just seems like duplicating an existing law though with the addendum of "If yer preggers it's worse cause of life you carry...." is just insane.
