Hello VJ community,

Just curious how long would it take for my wife to come to US after CR1 upgrade if we get married in her country. The reason I'm asking, when I apply for I-130 F2A during the waiting time of getting my citizenship, would they count the processing time before an upgrade to CR1 or I would have to wait for a standart time of what it takes for CR1 without any upgrades. I know it takes 2+ years for F2A and I'm worrying about this whole "upgrade" thing, is it a reliable and known process, or I should just wait for my citizenship and apply for K1 visa instead?

If you are already married you can go ahead and file for the I-130 and wait for the approval which can take anywhere from 3-7 months. When you get the citizenship you send in your request for an upgrade by either email or telephone. Usually you will get a response after about 3 weeks.

It worked for me and there is no reason why it should not work for you and it is reliable. Check out my timeline.

They counted the processing time in our case. It took approx. 2 weeks from upgrade to approval. Good luck!

Dear velrich,

I checked your timeline and it was a bit confusing, because it's says it was upgraded to IR? Is IR same as CR1? I was thinking about getting married in Moscow to my fiance while I'm permanent resident (and during the wait of becoming US citizen), then come back to US and send I-130 and wait till I become US citizen, and upgrade to CR1. Also it says 500 something days for the entire process until approval, is it pretty much back to back or you skipped some months?

Thank you! For how long would you say they were processing your i-130 before you became US citizen and upgraded? It must have been a while since you said it was 2 weeks from upgrade to approval. Are you still on some stage or after approval your wife was granted visa and entry to US?

You're welcome :) I am the beneficiary, my husband is now an US citizen. We were in F2A status pending approval for an year and one month or so. He became USC in Nov. 31, we upgraded the next few days and a week before Christmas we got approved. we are now at the NVC stage.

Is IR same as CR1?

The difference between the CR-1 and IR-1 is the amount of time a couple has been married.

If married less than 2 years, a CR-1 visa is issued. Upon entering the US on a CR-1, the foreign spouse receives a conditional 2-year green card. Within the 90 days before the expiration of the conditional green card, the green card holder must submit a I-751 Removal of Conditions (ROC) application. If the ROC is approved, then the foreign spouse will receive a 10-year green card.

If married for over 2 years, a IR-1 visa is issued. Upon entering the US on an IR-1, the foreign spouse receives a 10-year green card.

12/12/11: 2- year Green Card arrives in the mail

12/22/11: Applied for SSN at local office

12/26/11: SSN arrives in the mail

08/20/13: ROC window opens

10/03/13: I-751 package sent to Vermont Service Center

10/05/13: I-751 Delivered (Signed for by Karen Fitzgerald)

10/09/13: Check cleared bank account

10/11/13: NOA1 received (dated 10/07/13)

03/04/14: USCIS case status update: Card/Document Production (i.e. APPROVED!!!)

03/07/14: USCIS case status update: Green Card in the postal system; tracking number

03/08/14: Approval notice arrives in the mail (dated 03/04/2014; USCIS Office: Buffalo, NY)

03/10/14: 10-year Green Card arrives in the mail
