hello fellow vjers,

just a quick question. my friend is married to USC, enter through K1. she had a daughter which was not listed on the original K1 petition, she decided to get her daughter after adjusting her status. what do you think is the best way route to go through. I-130 or CR2/IR2? what papers and what requirements do she need.

any input and help will very much appreciated. thanks

I130 is the petition.

Cr1/Ir1 is the visa

They aren't really comparable

how old is the daughter,on the 1-129f it ask if you have children what did you put down,since you said she was not listed,thats a no no.the 1-130 cr-1 is for married couples, you could petition for the daughter if she is under 18,an if she is left behind you can file for her join to follow relative 1-824 form.

Was she still pregnant when the I-129F petition was filed? That will explain why the daughter wasn't listed in the petition? Did your friend list her daughter in the DS forms?unsure.gif Your friend's spouse (husband) can file I-130 petition for the step -child.

my friends daughter already a year old when her K1 petition approved. her daughter was not listed in the DS form. She and her husband decided not to put her daughter's name in the petition but they change their mind when my friend arrived the US. So are you saying that the (her husband) can file for I-130 for her daugher?
