Hey,

I have heard it is unlawful to enter the US with the intent to marry a US citizen on ESTA/WVP - even if you plan to leave the country after the wedding and apply for CR1 from outside of the country?

Is that correct?

Hmmm...it would be strange if it were unlawful. I entered and told them straight up at the border before I entered that I was getting married on the trip. But I also told them I was planning to come back right away and provided proof of this. But I'm not on the VWP or ESTA.

Canadians might be special, though.

If it is illegal, have you considered the I-129F - Petition for Fiance?

05/25/2022: Naturalization Certificate received in mail.

Thank you for the fast reply!

Yes, just that we wanna get married in the summer and I don't think we will get the K1 visa in time (we are also waiting for final divorce papers from a previous marriage, so we won't be able to apply for another couple of months at the least)

Any experiences from Europeans on this?

Incorrect. I was living abroad with my spouse and we came to the US to get married so my parents could be present. We stayed for 2 weeks and returned to the UK, then filed for a CR1. He came in on a VWP (as-was back then) and told them flat out: 1) he was visiting to marry his USC fiancee; 2) his USC fiancee lived with him in the UK and had a job to return to back there; 3) that we were staying for 2 weeks and returning to London. That was it.

What you propose is perfectly fine and people do it all the time. Entering to marry is fine, entering to marry with the intent to stay in the US and adjust is not.

It's not unlawful.

It is unlawful to come to the US with the intent to marry and stay.

Bring proof of your ties to your home country. ie. paystubs, letter from your employer, lease.

I got married in the US and then went back home.

like the others said before, its not unlawful. i did it too in august but i honestly wouldnt tell the officers that i will get married. when i flew i took off my engagement ring because i was paranoid they wouldnt let me in lol

(not because getting married is unlawful but just staying afterwards is, so i was scared thats what they would think)

in general only tell them something if they ask you about it.
