Fiance visa for Eu resident with Non EU partner

Hi,

My problem is that my fiance who is African is going to get a contract as a resident doctor in US, but they told him that he is only going to get a type of J visa for 3 years and then after an H. So my question is, how am I going to be able to get a visa and a work permit, can we stay as fiance or do we have to get married? Does anyone have any information regarding this?

*** Moving from K1 fiance visa (which is for US citizens marrying) to Student visa which seems the most applicable ***

There are no living together/ girlfriend visas in the USA. You could visit on the visa waiver program, but not live in the USA.

If you get legally married, there are some student visas which allow the spouse to come, but you will likely not be allowed to work.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you married the J would come with work authorisation, the H would not.

Or you could apply for a B2 Cohabitating visa. No work but also no marriage needed.

Thanks a lot for the replies....OMG, so it is not going to be easy, I thought so.. :( So as far as I understood, I won't be able to work with the H, but the J yes? Sorry for stupid questions, but I am really confused right now :(

It means we cannot stay as fiance....And do you know if we get married legally of course and he happens to get the H not the J, after I apply for the spouse visa, and I live in US for a certain time period, can I try to apply for jobs or even applying is not an option??

I see, thanks a lot, I feel much better :), I also checked the Embassy Website and found out more about J1 and J2 visa...
