you claim you open the envelope by accident but why embassy personnel insisting something missing?? probably bcoz something was missing. something here is not right. yea this could affect your new case.

yes they said something was missing ! and i am not sure what it was but even if it was something missing i never intended to misplace or tamper with my own paper !! i hope you understand what i am trying to say !

the 'old fiance file ' will get sent to storage at the National Benefits Center. This concept of 'London still having it' - don't fret that..

When an adjudicator sees the prior K-1 in the system, they'll request it, maybe, or just look at the electronic record.

OUTCOME on the prior K-1 is considered, but the I-130 petition gets adjudicated at USCIS, by their rulebook.

Later on, the Consular Officer at London will adjudicate the Visa Application, and of course will see a record of what happened on the K-1.

The Visa Application, CR-1, would be adjudicated on it's OWN merits, and the totality of the casefile .

IMO, the prior outcome on the K-1 will be a factor, but a SMALL factor, if the I-130 casefile is complete (hint, read the instructions and know what to submit for the 6 types of bonafide marriage evidence)

I don't think USCIS will need the old file to adjudicate your new case, this is entirely new petition.

But your chances to be approved for a new visa at the Consulate may depend on what was recorded in the DoS system as a reason for your K-1 cancellation.

Have you received anything in writing from the Consulate at the time your K-1 was canceled?

hi and thank you for your answer :) when that officer canceled my visa she didn't give me any thing or any paper!! all she told me was : there are some important paper from your petition missing and you need those paper to be able to get in USA at POE so she said unfortunately i have to cancel your visa and you need to apply all over again and your fiance needs to petition for you again !! that's all she said to me .

then my now husband called a senator and apparently he called the US embassy in london and they mentioned that there was nothing wrong with my case only becuz i lost those paper we have to apply again ! this is what exactly happen and i even have the email from consulate that they sent to my husband ,if you want i can put it here so you can see ,all i am wondering right now is if USCIS may need that old fiance visa file back before they can approved our I-130 ???
