HI everyone,

I came in US in June 2008 as a exchange student for 3 months, J1 visa (2 years rule does not apply). In September 2008 I applied in US for a B1 visa for 6 months and reapplied for another tourist visa in March 2009 also in US, I had the second B1 visa until July 2009. Since that time I was out of status.

After dating my girlfriend for almost 2 years we decided to get married in Oct this year. She is a born US citizen. We want to apply for my AOS but I am not sure what is my current status according to USCIS on form I-485 and I-765 box 15 , J1 or B1?.

B2. I simply refuse to accept that you got a B1 only. A B1/B2 perhaps, but not a B1.

More opinions folks on what should I put? Just want to make sure

Well it asks for your "current" status, not the status 2 years ago... So put B2 in there, if you wanna make sure, just put "expired" or "overstayed" behind it, you have to put the expiration date into the form either way, so they will see.
