Hello all,

My oath ceremony for citizenship is scheduled for Dec 19th. Our PD in F2A category is 11/01/2010 (according to Dec VB, cases as of 08/22/2010 are current). Which would be better for us, stay in F2A path or convert to IR1, or don't we have a choice? Trying not to take any action that might cause any more delays.

Thank you for your replies.

When i upgraded i kept my same priority date, if yours stays you would be brought to the top of the queue. That would save what seems another two month wait. IMHO. With me it just helped that they had to do anything to it. I believe I got approved just because of the upgrade. No one from June has been approved under normal circumstances, but I was.

Good luck either way.

Thank you for the replies. My point is, we are thinking our PD will be current almost by the time I upgrade our case to IR1, which is okay, as long as it doesn't add further delay because of the conversion.

Upgrading will not cause delay. As long as they Consulate knows you are a USC at the time of the visa issue, it will be IR1 anyway.

According to the visa bulletin it will take another 2-3months for your PD to become current and if you upgrade it will take the same time but the advantage is that your spouse comes here to the US as spouse of USC so he/she can become citizen in 3 yrs time, there will be no conditions on his/her residency and also this is certain compared to the F2A because sometimes it is not very steady processing. I understand the feeling if there is a slight delay via the upgrading but think of the advnatges and the peace of mind. Even at the consulate the interview is kind of relaxed for spouse of USC compared to spouse of alien resident!

The only process for this whole upgrading is for you to scan, attach and send your naturalization certificate via an upgrade request email to NVc. Boom!

I have been there just like you and is enjoying this moment waiting for my hubby to join me soon after 2 years of wait. Hope this helps, IK

Thank you capri-Scorp and Deep2009 for the replies. I will notify NVC as soon as I get the naturalization certificate.

Another question, I have been reading and some posters mentioned 'being there at the interview'. Is USC allowed to be present with the spouse for the interview?

No they are not allowed especially for IR1/CR1 cases unless major exception. One of my VJ friends got a reply directly from the enquiry center that USC's are not allowed and translators are available. These are the contact numbers they provided in regard with this: Please write to support-india@ustraveldocs.com, visit www.ustraveldocs.com/in, or call (91-120) 660 2222, (91-22) 6720-9400 or 1-310-616-5424 (calls from the United States) for more information.

Thank you. I had emailed them about translator. They don't have one available for our language, but we are free to arrange on our own. Now, finding one in Mumbai is on us.
