Hello,

I have a B1 visa for 10 years. It has been already 3 years that i'm travelling back and forth between france and US. My employer is French and they are sendding me to a US client for UAT,train the business user get requirements... It is a big project.

Last time the immigration stopped me for 2hours asking me why i was coming that often that they suspected that i was working illegually. I explained them that i'm paid by my french company, that i have a french contract. they let me in but told me that i should go to the US ambassy and check for another kind of visa. i called the ambassy but the guy that answer told me that my client should petition for a visa for me. My company decided to let me in france for a while before i go back.

It has been 10 months now and i'm going back next week.

In those 5 years i met a US citizen and we want to get married in january while i will be in the US on my B1 visa.

Can i do this? should i wait for sometime (90 days) and then get married and start my change of status knowing i might not be granted 6 month when i enter to the US?

We don't want to do a k1 or K3 visa. it will take too long and meanwhile i won't be able to go to the US.

Anyone was in the same situation and got married on a B1?

It is ok to get married in US while on B1 but intention to come into US, get married and stay to adjust status is immigration fraud.

You could get married in US and then have your spouse file CR1 for you. But you have to go back to your country for medical and interview.

Your plan is fraud, and no one on this board will help you with it. Sorry.

Fraud would be to get married for the wrong reason and just in order to get the green card.

I know people do it everyday and being apart from the person you love for 8 to 10 months is a lot. I'm not saying the US immigration is doing the wrong thing but when it happens to you, you feel it is unfair and you want to find any solutions.

i just wanted to know if some people got married on a B1 and did an overstay and how did it work for them.

I'm not asking for help just for sharing experiences.

Thank you i understand. It is just that you read different information on forum. One being that there is the 30-60-90 days law and that lot of people chose this process and that most of the time it was advised by a lawyer.

Now i understand that there is the solution of getting married in the US and then i go back to my country while my husband file for CR1. But what is the difference between CR1 and k3 visa? is it faster to do the CR1?

K3 is obsolete. CR1 is the way to go.

While you are in US, your spouse could start the CR1 process by filing I-130 form.

Then you leave US when your authorized stay is up, and prepare for the medical and interview at your home country.

This way, you minimize the time of separation from your spouse while waiting for CR1.
