Actually it depends. If you are talking about a widow(er) under the age of 60 ( or 50 if disabled) the benefits will end if they remarry for themselves but will carry on for any minor children. So if the benefits are ending no ( and if they are petitioning a new spouse they had best ended the benefits already )

3 children and widower (One child is 19 youngest 5). Since there income is under the guidelines can they use the social security?

Or since its now for the kids only its not considered income they can claim?

So the 19 year old will or has aged out, and he has remarried and if young is no longer able to collect. That leaves 2 children. So he has a family size of 4 or 5 depending on the status of the 19 yo. He can claim the benefits the younger 2 get as household income. If he hasn't reported the marriage and the marriage causes the loss of income it is best to do it asap as they will recover the excess paid.

okay i advised them that if they add the social security to their total income they need to show documentation from Social Security stating how much for who and all that.

Her benefits ended when her child turned 16. She has also the 17 and 5 year old still collecting.

Wouldn't a CO think this is shaky and iffy and want a co-sponsor?

SS survivor benefits act like child support . They are a regular predictable source of income that offsets the cost of raising a child. They should be ok with the 5 year olds but how close is the 17 yo to 18 as that one may age out also.
