Quick help with I-129F

Hi everyone,

I've asked this question before, but need clarification... (please forgive me!):

We just got NOA1 for our I-130 (YAY!) and are now getting ready to send our I-129F. Question 11A says: "Have you ever filed for this or any other alien fiance or husband/wife before? If yes, give name of alien, place and date of filing and result."

Ok, so what do I put here? Do I check "yes" because I filed an I-130 for my husband? And if so, what do I put for date of filing and result? Do I put the date we MAILED the I-130? Or the date we received NOA1?? And what is the "result?" Do I just say "NOA1 Received?" (I mean, I can't say it's been approved at this stage.)

Confused as to what is appropriate to list here.

13 Feb. 2006 - sent I-130; 14 Feb. 2006 - I-130 received at Nebraska

28 Feb. 2006 - NOA-1

2 Mar. 2006 - RFE for payment problem; 3 Mar. - corrected & mailed; 6 Mar. - USCIS rec'd payment

12 June 2006 - APPROVED! (NOA-2)

20 June 2006 - case number assigned

3 July 2006 - DS-3032 and AOS Fee bill generated; 6 July - emailed DS-3032 Choice of Agent

13 July 2006 - Received DS-3032 (UK)

14 July 2006 - DS-3032 mailed to NVC

17 July 2006 - DS-3032 and AOS Fee received in mail

19 July 2006 - mailed Fee bill to NVC; recieved at NVC St. Louis facility 20 July

4th-8th Aug 2006 - Recieve IV bill. (non specific date recieved/away vacation)

10th Aug 2006 - NVC recieve IV Bill.

11th Aug 2006 - Recieved I-864 package / mailed back 15th Aug

I-129F:

6 Mar. 2006 - sent I-129F; 8 Mar. 2006 - I-129F received at USCIS

16 Mar. 2006 - NOA1

3 July 2006 - received RFE (IMBRA); 5 July 2006 - mailed RFE response

10 July 2006 - received USCIS email confirming receipt of RFE response

13 July 2006 - received RFE (IMBRA) AGAIN

17 July 2006 - mailed 2nd RFE response; received by USCIS 19 July

27 July 2006 - APPROVED!

7 Aug 2006 - case number assigned at NVC

11 Aug 2006 - Recieved NVC letter confirming case sent to london

23 Aug 2006 - Received Packet 3 / 25 Aug 2006 - Mailed back

04 Sep 2006 - Medical completed.

08 Sep 2006 - Interview date assigned for 2nd October

I don't know how everyone else did it, but I put "No" because I've never filed that form for anyone else before. The I-130 I filed prior to this I-129f was part of the same process, so I didn't count that. I don't know if that's what they mean, but that's how I did it. :whistle:

17-Jan-06: RFE from TX due to "lack of payment"; USCIS won't accept credit card form from Embassy

01-Feb-06: Sent new I-130 to TX with personal check

13-Feb-06: NOA1

02-June-06: NOA2

05-June-06: Case received at NVC; case # assigned

26-June-06: DS-3032 Choice of Agent rec'd via snail mail

06-July-06: DS-3032 COA mailed; AOS bill mailed

24-July-06: IV bill generated

31-July-06: I-864 rec'd via snail mail; IV bill rec'd

31-Aug-06: IV bill mailed (delayed due to move to US)

21-Sep-06: DS-230 rec'd via snail mail

02-Oct-06: DS-230 & I-864 mailed

08-Nov-06: Case completed at NVC & forwarded to London Embassy!!!

28-Feb-07: Final Interview at London Embassy

01-Mar-07: Visa in hand!!!

10-Apr-09: Biometrics Appt

02-Sep-09: Approved - 10-yr Green Card Production Ordered

The question doesn't ask for any immigrant petition you've filed someone. It asks if you have filed an I-129F for your spouse or any other person before. If this is the first time you've file an I-129F then asnwer no.

Why would you file the 129F? You said you are already married, The 129F is for Fiance
The reason you have to file the I-129F is because it is the same form used when applying for a K-3 Spousal Visa.Yes-it is called a Fience petition, but in fact it is also a spouse petition (you simply use the word spouse instead of Fience when reading the form)..The I-129F allows the alien spouse to come to the U.S. on a non immigrant K-3 Visa(just like the K-1 Visa allows),This way you and your alien spouse can be together in the U.S. while waiting for the I-130 Immigrant Visa to become approved-or something like that :unsure::lol: .The I-129F is a required form when applying for a K-3 spousal Visa.It is kinda confusing at first but once you figure it out it all makes sense :yes:

It doesn't say I-129F, but I interpreted that way. The question itself is too vague. You can choose to interpret it broadly and apply it to any petitions you've filed for an alien fiancee or spouse. I don't think the form intended the question to be that way so I choose the stricter interpretation of "have you ever filed an I-129F for anyone?"

The sample form on VJ marked no. I marked No on my I-129F and didn't receive any RFE for it.

Your first post sounded much more definite than that, no indication of vagueness at all!

I wouldn't expect you to get an RFE for that answer to that question in your circumstances - you provided evidence of the I-130 already, as part of the I-129f application, did you not? If you'd answered 'no' and there had been a previous petition for someone else, things might have been different.

I marked No on my I-129F and didn't receive any RFE for it.
