Hello,

I am on F1 OPT now and doing a concurrent filing (I-130 and I-485). In the I-485, for the question on Application Type I am little confused what is the bullet appropriate for me. For now I checked option 'h' and wrote "I married a US citizen." Is this fine? Please provide me your opinion.

A is correct. H is wrong.

Thank you for the reply. The option A reads "An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or relative, special immigrant juvenile, or special immigrant military visa petition field with this application that will give you an immediately available visa number, if approved."

But I don't have any immigrant visa number. I came to US on F1 visa which is a non-immigrant visa. Could someone please clarify how option A is appropriate to my case.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

"An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved."

I-130 = an alien relative petition.

Essentially (a) says to either enclose an approval notice or file a named petition that, if approved, would make a visa number immediately available to you.
