I am just waiting on my Interview in Montreal next month to be able to move to the States on a K1 visa..

We plan on getting married within the 90 days.. it will be a short and sweet ceremony. I understand that once i cross the POE I will not be able to retun to Canada till I get my green card. I want to be able to have a wedding back home in Canada with all my family and friends, but is this even doable? Could I fill out a AP while waiting on my green card? The wedding would be a year after im living there..would this be safe to do?

Yes of course! after you guys get married, file for AoS ASAP, you can file for your AP along with your EAD (work permit) and usually arrive within 65-70 days. Is a great option if you need to travel outside the states while your Green card is still pending. That's what I did!

You can have all the weddings you'd like, wherever you'd like. Have a ball and a big celebration!

The first marriage is the only legal marriage and the one that counts.

After your marriage in the US, go ahead and submit AOS and along with that, EAD and AP. AP lets you travel to home country and reenter the US while AOS is pending without abandoning AOS as long as you have AP in hand before leaving the country, and of course when entering again.

It's good to have regardless of a planned trip to your home country in case of emergencies back home until your AOS is approved.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Thanks for the response, I just was not sure if they will question why im bringing a wedding dress back to Canada? or if that would be a issure at all?

We have our 90 day wedding planned as soon as I arrive... but we also have another wedding (bigger one) planned for in the states this coming summer..and a lot of family cant make it..its so pricy for a flight and hotels..I really would like to change things and have the 2nd wedding back in Canada so everyone can attend.. I dont know how long the AP takes to get so im not sure if its even worth the hassle to cancel the summer wedding and plan a new date for Canada if once again we are not sure when I will be able to cross the boarder.. :(

File for your EAD and AP when you file your AOS. 4 months or so to get a AP. We got married and then a month after that had a big reception at the ranch with a wedding cake, big BBQ and lots of friends to celebrating our marriage. Sounds like you really want to be married in Canada, then file for married not K-1, but this will delay your life substantially.

Thanks everyone! :)

I have desided to keep everything the same..and when the time comes the my green card is in hand me and my Fiance (well husband by then :) ) are going to make the trip back up home to Canada and have a celebration with family and friends that couldnt make it..like a 2nd reception. :)
