Long story short, we filed back in the beginning of July, and almost 4 months later, we still haven't received an interview notice.

I've called and spoke to a second tier rep, who confirmed no interview had yet been set.

I know there are people on here who have come close to 100 days when waiting for an interview date to be set, but form what I can tell, no one has waited almost 4 months.

After speaking with my lawyer, I know he is representing cases for others, who filed after us who have their interview dates already set.

Is there anything to worry about? Is there anything serious that could happen from here that I should worry about? What could be taking so long with our case, a case a thought was straight forward!

What can I do? As literally every day, Im becoming more and more stressed by this, and its starting to affect my health!!!

AOS Journey

Day 0 - 07/10/2012 - AOS package (I-130,I-485, I-175) mailed to Chicago with FedEx.

Day 1 - 07/11/2012 - Confirmation from FedEx that package arrived and was signed for.

Day 3 - 07/13/2012 - Text confirmation from USCIS of receipt.

Day 4 - 07/14/2012 - Online banking shows that cheques were cashed.

Day 9 - 07/19/2012 - Received 3 out of 3 NOA letters in the post.

Day 11 - 07/21/2012 - Received biometrics appointment letter, appointed set for 08/07/2012.

Day 16 - 07/26/2012 - Completed biometrics walk in.

Day 56 - 09/04/2012 - Received text notification to state that my EAD has been ordered into production.

Day 59 - 09/07/2012 - Received 2nd text notification to state that my EAD has been ordered into production.

Day 62 - 09/10/2012 - Text notification that EAD has been mailed.

Day 64 - 09/12/2012 - EAD received in the mail.

There is absolutely no reason to worry. The reason you haven't gotten an appointment yet is that your local office is busy. Plenty of people have waited 4 months for an appointment notice. I look at your timeline, and you are at 3 months and a week. That is much different from 4 months. The fact that you haven't gotten an appointment letter yet has nothing to do with your case.

Have you moved at all?

We waited over 4 months for an interview notice. Many have waited longer. It is nothing to panic about. Try not to compare to other people unless they are at your field office AND filed the same time.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.

You're also in CA and I know that a few people have had to wait a bit longer in the LA area than is usual. Hopefully you'll get an interview notice soon.

11/29/12 - AOS Interview in Atlanta - 10 minutes long and approved on the spot.

And today its been 110 days since filing, which puts us 10 days away from 4 months...which is why I said about 4 months, as its going to be here pretty soon.

From all the timelines I have seen, those that have waited for over 4 months, had one or more RFEs. We have had none.

I notice you recieved an RFE, which would have obviously added a delay to your case. We have no RFE.

And I don't think I made it clear in my opening post stupidly, but speaking to my lawyer, he is representing others at the same field office as us, who have filed weeks after us, who have their interview dates already, hence my frustrating comparisons.

Well, your NOA1 appears to be from 7/14. It is now 10/28. That is 3 months and two weeks.

Really, a late interview indicates nothing. I know you think that they have concerns and are delaying it, but that's not how it works. Have you compared current timelines at your local office? When is the last time your lawyer had a concurrent AOS case at your local office?

It really means nothing. You can try for a service request, but otherwise, you have EAD and AP so live your life normally and I bet the notice will show up soon.

Our RFE was for AP and it didn't affect biometrics or anything. We had our biometrics and interview on the same day as several other VJ members who filed at the same time at the same office, so I don't think that was an issue.

That said, I can definitely understand your frustration if other people are getting approved quicker at your office!

I'm in the same boat as you except that I'm now at 126 days (4+ months). It's really frustrating. We're going to call the USCIS tomorrow but we're not sure what to expect. The online system tells us that our case is at the NBC but that office no longer even has timelines for I485s posted.

NBC never has timelines for I-485s because they don't approve or deny those. Check the times for I-485 at your local office. That's what to gauge it by.

NBC never has timelines for I-485s because they don't approve or deny those. Check the times for I-485 at your local office. That's what to gauge it by.

Ok I just looked and it says they were processing I485s from May 23, 2012 on Sept. 30. That puts them about a month behind us a month ago. Frustrating.
