Hi there

First thanks for this awesome board you provided for us.

I won GC lottery couple of months ago and moved to USA with my husband and our son, after a short time we all got our green cards.

Unfortunately I moved back to my home country and I'm about to get divorced from my ex husband.

Now I want to get married to my fiance, We're planning to live in the USA, my question is whether I can petition for my new husband or not? considering my ex husband got his GC based on our marriage. I also want to be sure that his green card won't be affected by this action.

Your help would be appreciated.

*** Moving from US Citizenship to Bringing Family of greencard holders ****

Good news first: Yes, you can petition your new husband, assuming you will be moving back to the USA soon (without him at first) to keep up your greencard- you will loose it if you stay in your home country too long.

Bad news: the timeline will be highly suspect. You win, move to the USA, and within only month not only do you leave and divorce your husband, but you already have a new fiance/ soon to be husband lined up. They will look VERY closely at both your old and new relationship.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Probably not, unless they decide that the first marriage was fraudulent and only entered into because of the lottery, or that you were not in a bonafide relationship wit him anymore at the time you all received your greencards (ie if they think you were going to divorce, but stayed married on paper so he could get the greencard).

You will have to maintain your residence in the US , your new hubby will not be eligle for a visa for about 2 years after you file. Getting divorced and married so quickly will mean that the look closely at the relationships. What country are you from ? And who was the actual lottery winner , you or your ex spouse.
