I485 A SUPLEMENT

hi,

i am married to US citizen, and entered to USA with a Non immigrant visa(was inspected), my visa expired on dec 2011 and i overstayed. i filed form I130 than filed form I485 AND I485A. I just received a request for evidence, saying that i am supposed to include the filing fee of 1,000 and evidence of eligibility to adjust status under act 245(I). Was i supposed to file supplement A to form 1485? if i made a mistake filing this form how can i make corrections for the form to be disregarded?

You weren't supposed to file 485A. That form is for certain people who EWI many years ago. I am not sure exactly what you would need to do to withdraw it. Someone else can probably help you with that.

That option is included as a possible fix when you did not include proof of legal entry. They are not asking you for it, it is just listed as one way to overcome this, but it does not apply to you. What did you send to prove you entered the US legally?

I SENT A COPY OF MY NON IMMIGRANT VISA - IT WAS A BORDER CROSSING CARD

I think the problem is she actually filed the 485A with her application so they think she EWI. I recall at least one other case where that happened but I'm not sure how they fixed it ...
