OPT expiring - filing for I-485 - cutting it close - continue to work??

My wife is working via her OPT/EAD status under her f-1 visa. The OPT expiration is this coming January, 2013. Her immigration physical exam is early November, 2012. We will file the I-485, I-765, etc., immediately after the physical. Can/should she continue to work after her OPT expires?? Thanks sooo much,

I would not. Once her OPT expires, she will not be allowed to work based on her AOS application. She will have to wait for her EAD to resume work. Actually, I am not even sure whether OPT is still valid once you apply for a change of status, but more knowledgeable VJ members will give you a more precise answer.

No she can't - unless she gets EAD. Why you can't do physical now rather than in November ?

- 7/23/2008 came to US with F-1 visa
- 9/11/2012 I-485, I-130 and I-765 package sent to USCIS Chicago lockbox
- 9/12/2012 package delivered and signed by XXX
- 9/14/2012 received email with receipt numbers
- 9/17/2012 check cashed
- 9/30/2012 received hard copy of biometrics appointment on 10/19/2012, notice dated on 9/21/2012
- 10/12/2012 successfully walk-in one week earlier without asking reason at New York Long Island City office
- 11/5/2012 started to work in a new firm
- 11/11/2012 EAD approved!!! AWESOME!
- 11/19/2012 EAD card delivered, one day ahead of my birthday!
- 1/11/2013 received txt and email about interview time
- 2/14/2013 interview - Got APPROVED on the spot!!
- 2/27/2013 USCIS online update - 485 decision!! we mailed you a notice that we had registered this customer's new permanent resident status :) Later, my 130 update too!!!
- 3/4/2013 Card Production!!

- 12/19/2014 early bio done in Long Island City Office!

That's correct. OPT is no longer valid once you apply for AOS. When you apply for AOS, your wife will be on one status which is pending.

That's why I would suggest your wife work until her EAD is about to expire; since technically she shouldn't be working once AOS is sent.

09/28/2012 (Day 39): Contacted Congressman for EAD expedition

10/10/2012 (Day 51): EAD status updated: Production of card ordered

10/16/2012 (Day 57): EAD mailed

10/18/2012 (Day 59): EAD received!

01/31/2013 (Day 164): Received Appointment notice for an interview

02/04/2013 (Day 168): Received Appointment notice letter

03/06/2013 (Day 198): Interview at National Benefits Center, NYC

03/08/2013 (Day 200): Received Status update: Card/Document Production, I-130 approved

03/14/2013 (Day 206): USCIS mailed the card

03/17/2013 (Day 209): Received green card

The OP does not have much choices...I was in the same situation. In my area there was only one Civil surgeon that was offered by USCIS and I knew if I cannot make it for the appointment that would be available three days later when I visited them to make an appointment then the next one would be only the end of the following month...it sucks. Anyway, as others stated, I believe the same thing, one cannot work once OPT expires. But once she gets her EAD card she can resume work.

All the best! And don't worry, EAD arrives less a month from the time you mail your package in, so she would only "miss" one month of non-employment...
