J1 and us citizen marriage

Hi guys,

Im a j1 visa holder (not subjected to 2 year rule) and i just got married recently with my girlfriend and we found out that we are going to be a proud parents in 8 months.

Here's the thing, my visa is going to be expired this december and i have to go back to my country for my graduation.

Question:

A. What is the very first step in the paperwork process?

B. will i be able to go home while im still filling my paper work?

Me and my wife really needs help.

Why does he have to go back home to start the process? Can't he just apply to adjust his status in the US?

There are two paths - one where you are guarantee to miss the birth of your child and another which is better.

You can either 1) return home and your wife files for a spousal visa where you wait in your country for 6-12 months (thus missing the birth) or 2) you can file to adjust your status in the US, go get an emergency AP so you can leave the US without abandoning the process, go home for your graduation, and then immediately return to the US to wait for your green card, be with your wife, and be at your child's birth.

Go with path 2. It is vital that you get the AP document BEFORE you leave the US.

I used to have a J1 visa not subject to 212e now a USC. My advise to you is do not go home. You and your wife should apply adjustment of status the I-864. The process is easier and faster if you have all the necessary documents. I got my conditional green card in the mail within 5 months after filing for adjustment of status. Please let me know if you more informations. I am willing to help you walk through the process. As I have done it already.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I used to have a J1 visa not subject to 212e now a USC. My advise to you is do not go home. You and your wife should apply adjustment of status the I-485 and together with I-130. The process is easier and faster if you have all the necessary documents. I got my conditional green card in the mail within 5 months after filing for adjustment of status.
