Hi Guys, :help:

My Fiance visa expired 6 months back.I could not go because my mother was going through major operation, and at that time I had to stay back to take care of her as my brother had gone out of country.

The day my Fiance Visa expired,I visited the US Consulate office,and informed them that I am not going to US on this visa due to the reasons.I showed the Hospital applications and bills also. The counsular there put the stamp of "cancelled without prejudice" over my US K-1 Visa, and asked me to get it applied again If I wish to go to USA.

Now please tell me how much are the chances of me getting that Visa again?

Can old case be re-opened? What exactly is the procedure?

You'll have to start by doing some research and investigating. The new IMBRA law indicates that if a previous petition was approved, a second K-1 petition cannot be filed before two years have elapsed since the filing of the first petition. However, there are waivers available - maybe your situation is valid for a waiver?

For a visitor or student visa, it all depends on whether or not you qualify and how difficult those visas may be to get from your country.

I would think your chances of receiving another K1 are about the same as anyone else's. It was "cancelled without prejudice". ie: the expired K1 shouldn't be held against you.

You may still have to file a waiver, though.

You think this country is a motel you can just walk in and out as you please? You better behave better to your fiance because if she boots you, you will be stuck in your country forever. Can you please stick to the topic? You are using distraction by calling me names and I wont fall for that. The poster called me names, because I asked about the fiancee, yet the K1 is predicated on the fiancee.

A foreigner cannot come here and tell us how he wants to come to the US with a cancelled K-1 and fail to tell us whether the fiancee still supports the application. As you can see, this person just wants to come to the US, its not the love, because even if they cant come on K-1, they are willing to use visitors or student visa. I would vote denial on the K-1, but thats just my opinion! I think the marriage is a sham.

My Fiancee Loves me.And she definately supports me.She herself is inquiring this matter if K1 can be filed again or there are chances of rejection.And I am trying to help her by gathering some information from the experiences of different people.If by any chance,K1 is not possible in my case,then I wanted to know if a visitor or student visa can help me.Otherwise,she is coming to my hometown to marry me.And then we will see,if I get visa or not.The only re-application of K1 is creating doubts on our minds.

And it is a common sense question,that if and only if my Fiancee is ready to apply K1 visa for me,then and only then I will inquire about the K1 visa.If she is not ready,then why the hell would I enter into this forum and bug other people who are readily willing to help others.

If you were approved previously, then you shouldn't have any problems. I don't understand why you have such a fear of rejection this second time around. If everything is the same as before, then this petition should be approved just like the previous one.

Even with IMBRA, your US petitioner can file again (twice before a waiver is needed). This would be the second time.

Don't worry so much. Just have her file again.

Even if your fiance needs a waiver, if he explains the situation in his application, and you two are honest and thourough about this new process, you shouldn't have problems being approved.

"without prejudice" means that the fact you did not use the first fiance visa will not be held against you. They will have the file and when you re-apply immigration will see that there is no cause for alarm. In the application process you will have the opportunity to explain the circumstances of why you didn't use the visa - certainly, a very valid one and something that can't be planned for in the normal course of affairs.

You should not have any difficulty re-applying for a fiance visa, or if your fiancee comes and marries you in your home country, then she will initiate a spousal visa (K-3 or CR1). Unfortunately, there will be an amount of time while you will be separated on all of these visas.

Trying to visit the US may be difficult. Immigration does know you have a fiancee there so, depending on what country you are from, it may be difficult to prove to them that you have no immigrant intent on this trip. You would have to be prepared to provide substantial proof that you are a bona fide visitor and not coming in and planning to stay. One thing to remember, if you do get a visitors visa with the intent that you can then marry your fiance and stay in the US with her, you need to rethink that: it is considered immigration fraud, and carries the very real risk that your after-marriage application to stay in the US will be denied. You can get married, but then leave the US at the end of the visa to go through the rest of the spousal processing abroad.
