Hi all,

My parents have a immigration petition approved (F4) that is based on my uncle in the US. Their priority date is in August 2001 and they have been waiting for 10+ years.

On the other hand, I have been studying in US for the last several years and I will graduate from my university in the summer of 2013. Since this probably will be their last chance to attend a commencement of their child, my parents really want to come. However, given the current application processing speed (currently for F4, March 2001 in the visa bulletin), there is a big risk that they will not be able to finish their interview and get their immigration visa by that time.

I wonder whether there is a way that can temporarily bring them to visit me in the summer next year?

Appreciate your attention.

It would depend upon what country they were from and how strong their ties are to that country.

They are from China.

Are you saying that they can try to apply for B1 visa? Isn't it that a person when processing for an immigration visa (or petition) will get denied 100% of time if they apply for a non-immigration visa?

They won't get denied 100% but yes, it will be difficult. A denial won't affect the immigrant petition though, so it's worth a try.

There is also a chance their immigrant visa will be approved by then, they should try and prepare for that process as much as they can so as to not loose time along the way.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

not necessarily. if there is reason for consular officer to believe that your parents will return to china at end of visit they may receive a visa. their economic standing and existing employment is key.

the fact that they have someone (brother) to "catch them" should they choose to stay illegal in USA is a negative, but not definitive. daughter on F visa in USA is also perjurative, as odds are you will not return to china, whether you get married here, stay illegal, somehow stay legal, etc. your visa was intent to return china, and will be seen as support should they want to overstay tourist visa.

hard to get real numbers on visa success rates from GZ, and china is a high fraud country, with too many F1 and H1b and B2 overstays. all the overstays prejudice chances for all applicants. long history, no sign of changing ethic, so continued denials. cultural problem.
