Hi,

I am during that window where I can apply for citizenship based on 3 years married to US citizenship. I have lived 2 years and 2 months straight in the USA without ever leaving USA soil but then I had to travel outside the USA and stayed there for a bit over 6 months. Am I still able to apply for citizenship? Please consult.

You are not eligible yet to file for Naturalization. You have to be a permanent resident for 3 years or more & married to your US citizen spouse for that 3 years.

i have been married for 4 years and been resident since 2009 so in november i ll be a permanent resident for 3 years so right now its the right window for me to apply for citizenship.

Oh, sorry about the confusion blush.gif. I wasn't reading the whole context of your post. I only saw the 2 yrs & 2 mons living here in the states.

Are you back in the US now, also don't you have to have physical presence in the US at least 3 months prior to filing.

yes im in the us right now and back in the state where i was before i went on vacation... does the 3 month rule count still?

It may or may not come into play when you apply, but that time away won't be counting towards it. The main thing is make sure you have enough proof and reasoning to present to the IO when you do apply about why you were out of the country and make sure you have a lot of evidence that shows during that time you had significant ties to the US as over 6 months, it's up to you to prove and convince the IO you didn't abandon your GC in that time frame...

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.
