To Whom it May Concern

Our case number is xxxxxxxxxxx My husbands name is James xxxxxxxxx DOBxxxxxxxxx I am LaShanna xxxxxx the petitioner DOBxxxxxxx. I am wanting to file for an expedite on grounds of financial hardship. My husband is self employed as a dispatch rider in London and due to the cost of fuel it is hurting us both severely financially. He works 60 hours a week on the road trying to make ends meat and by the time its said and done with fuel cost the company that he is self employed through sends him a negative pay slip where he ends up owing the company money. This week alone it was -£15. I have attached a copy of his most recent pay packets. I spoke with a gentleman at the NVC and I am worried this will hurt our case because he is the one in financial hardship. The sooner he gets here the better because we are able to maintain a steady income here in the states without worry of any financial burden. I am having to wire him money to survive right now just to pay bills which is causing issues on this end because I am now paying for both of our bills and as you can imagine the cost of living is much higher than it is in New Mexico. As you can see in the past 3 weeks he has only cleared £144 and that is before taxes and national health is taken from his wages which is no where near enough to survive on in London. If there is anyway to expedite this and get him here sooner it would be greatly appreciated. I hate to think of my husband having to exist in such hardship.

I am hoping this is enough to help our case and not hinder it, I also attatched copies of his wage slips ... but it is getting so bad he can't even afford to eat, I am hoping that doesn't hinder him from getting his visa... do you think I did the right thing?

Sept 1, 2011: Met at a service station my first night in England

Dec 20, 2011: Married

Feb 20, 2011: I-130 Sent

Mar 12, 2011: Rejected because of payment, waiting for packet to come back so I can resubmit it with proper payment.

April: Another rejection because I signed in the wrong place

May 1 2012: Sent I-130 AGAIN

May 7 2012: Received NOA1

May 17 2012: Received NOA2

June 18 2012: NVC stuff came in

July 6 2012: Called because never received NVC info

July 10 2012: Email with instructions received

August 1 2012: sent out AOS payment and AOS packet plus the other form

August 29 2012: had to get on a plane and fly away from the love my life.

Sept 12 2012: still no news from NVC, refiling all of my paperwork... feels like we have been apart forever already

Sept 14 2012: Emailed 3032 and resent I-864 with case number on every page, cover sheet and rechecked about 35 times to make sure it was all right

Oct, 1 2012: didn't check well enough received RFE

Oct, 13 2012: resent the packet with the information needed by the NVC

Oct, 14: Husband sent DS 230 from the UK

What's stopping him from Giving up the dispatch riding and claiming JSA while he looks for another job? It's not much, but at least it's money coming in...

We have actually been talking about him doing that... at least he can get housing benefits and his bills paid for

The hardship needs to be on the USC, not the potential immigrant.

If you want to attempt to make a case for any sort of hardship concrete details would be needed ( cost of national health, etc.) "Higher than New Mexico" can't be quantified.

Even if this would hurt your case not that I am saying it would, you already sent the email. It can't be undone. My advise is to just pray for positive results. :thumbs:
