Just recieved a request for evidence (RFE). My fillipina fiance was previously married and we hired a lawyer and recieved a judgement of annullment. I sent the court judgement with my application.

The RFE says they recieved the judgement and it is ok, however they are asking for a document from the National Statistics Office (NSO) substantiating the annullment. They are also saying the document must have a "Court documents and Legal Instruments endorsment"

Has anybody had to get one of these? It sounds like it should be easy but I don't know.

Any advice would be appreciated

Actually after you get the finality of the annulment..that paper needs to be registered with the local civil registrar where the marriage happened and also at he local civil registrar where the annulment was granted..after that, the Local civil registrar where marriage happened will register the annulment and will forward the paperwork with the National statistic office. Then you will be advised to wait a certain period of time and after that to follow it up with the NSO of they got the papers. Ones NSO gets the paperwork they will update the annulment information in their database and then you will be given a period of time as to when the annotated Marriage contact will be secured. Basically, the official finality of the annulment process ends when the NSO is able to anotate the marriage contract and be ready for issuance.

They're probably asking for the CRS Form 5 - Advisory on Marriages (CEMAR), annotated Null and Void Marriage Certificate from NSO and the Certificate from the City Civil Registrar with official seal and Certified Copy stamp. Sorry, that's all I could think of as supporting docs for annulment. Good luck!

Dean_De has correct answer! :thumbs: Having a court judgement / finality of the annulment is not enough. It has to be annotated in the previous marriage contract. Also, this must be printed out in security paper issued by NSO.

Aside from the annotated marriage contract from NSO, it would be helpful during the interview, if your fiancee could also request for her updated certificate of marriage -- NSO will certify that her previous marriage was annulled.

Thanks for all the help. At this point we are hoping the lawyer took care of this already and all we need is the doc from NSO. We will find out tommorow when my fiance visits the lawyer. If he did not do this yet...anybody know how long this normally will take?

Thanks for all the help. At this point we are hoping the lawyer took care of this already and all we need is the doc from NSO. We will find out tommorow when my fiance visits the lawyer. If he did not do this yet...anybody know how long this normally will take?

I myself was annuled we only included my finality and court decision on our petition now i get worried we will get the same RFE..but anyways if she has already her finality she can go to LCR where she got married to register it will take around a week, then bring those documents from LCR to NSO east avenue quezon city it will take three weeks from there, then bring the NSO annotated MC to RTC for the final decree, approximately will take a month to complete everything...goodluck!

I myself was annuled we only included my finality and court decision on our petition now i get worried we will get the same RFE..but anyways if she has already her finality she can go to LCR where she got married to register it will take around a week, then bring those documents from LCR to NSO east avenue quezon city it will take three weeks from there, then bring the NSO annotated MC to RTC for the final decree, approximately will take a month to complete everything...goodluck!

hi there ! we just got our rfe mail asking for LIABLE copy of the annulment marriage decree certified by the Philippines NSO that shows termination of my previous marriage. When we filed for our Fiancee petition 5 mos ago, I decided to include my NSO anotated marriage certificate together with my other court documents. But the one I recieved from Main NSO wasnt clear enough, so I assumed thats the reason why they have given us rfe. Last week, I went to NSO outlet and got clearer copy of my anotated marriage certificate, even if the uscis ddnt mention anything about CR5 Advisory on Marriages, I also sent it to my fiance, for legal support document.

I just wanna know, should someone like me really need to go back to RTC show them my anotated marriage certificate to get the final decree? Isnt what we provided the uscis court documents not consider final decree of annulment? anyone pls?

Correct. The annulment is not complete until you receive the annotated marriage contract from the NSO. Until duly registered, the person is neither free nor legal to re-marry, which is one of the requirements of filing for a K1 or spousal petition.

Most attorneys consider their work finished when the Decree of Annulment is issued by the court. The registration of the Decree with the LCR's and NSO is typically left up to the client to accomplish on their own, as it basically involves the transportation of documents from one place to the other. (and about 6-8 months)

Often times these final "do it by yourself" steps are not completely understood by the client and immigration petitions are filed prematurely, and even civil marriages have known to have been performed prior to receiving the annotated NSO. In the later case, overlapping dates of marriage appear on the CEMAR/CENOMAR which causes big trouble at the Embassy, more delay and attorney fees to straighten out.

NANCY & DAVEY: RTC = Regional Trial Court. equivalent to County Civil Court in the US of Ache.

The NSO copy of the marriage contract with the annotated annulment of marriage is the final document. The steps are as follows: Decision and then after 20 days from receipt of the Solicitor General and no appeal was made by that office, an Entry of Judgment will be issued by the Court. Then you will register the decision and entry of judgment to the LCR. The LCR will then endorse the said documents to the NSO. And you will get a copy of the endorsement to show to the court that the decision was already endorsed to the NSO. The Court will then issue a Decree of Annulment. Now keep that document with you. You will wait for 15 days for the NSO to input to their data base the decision and the entry of judgment. After 15 days, you can now request for a copy of your marriage contract with the annotated annulment or decision. You will wait for another 15 days to get your request. So the documents that you should have are the following: The decision, the entry of judgment, the Decree of Annulment and the annotated Marriage Contract. You must also request for CEMAR from the NSO.

Hi there, can I ask if I still be able to return to the court show them my NSO anotated marriage certificate to get my Final Decree of Annulment? Was the entry of judgement and certificate of finality are the same? someone says that the court decision is the same as the decree of annulment, thats why Iam really confused..sorry!
