After our K-1 visa is approved (hopefully) and I move to the US and get married - what is the procedure?

I read somewhere we then have to file for Adjustment of Status, but how long does this tend to take after filing? And can I work in the US while this is being sorted out? Or do I have to wait until I get it through?

Thanks!

Please read through the guides that TinTin and Mike conveniently provided for you.

After you get married, you can file for adjustment of status. You should also file your Employment Authorization and Advanced parole documents at the same time. (it goes out all as one package) The cost is $1070 (unless changed very recently). When you read the directions for the employment authorization and advanced parole, you will see that it mentions a fee for filing. If you file everything together, they basically are free.

Historically, the employment authorization document and advanced parole, from now on referred to as EAD/AP, should be approved within 90-110 days.

So make sure you go over every detail in the guide, go ahead and download the forms and instructions and study them intently.

Good luck

When you get married, you can fill for AoS almost right away if you have your marriage certificate and all the items USCIS ask, with you. And NO, you are NOT allow to work until you get your EAD (work authorization) or your green card. Usually takes 2 or 3 month to get the EAD and 4 to 7 month to get the green card. The adjustment of status grant you to be completly legal inside the US. Usually when you file for AoS you are filling fir : I-485 (green card), the EAD (work authorization) and advanced parole (trip authorization). The last 2 are completely optional and the fee is include it with the i485. You should take th cause the waiting for i485 is long, so they allow you to work and travel while you are waiting. Once you get the green card, you dont need them anymore.

Ohhh forgot something!!! About the SSN. Usually, you can get even if you are not married yet. But I highly recommend to all those ladies who want to change their name, to wait to be married to go and get the ssn. In my case, when I went to get mine I was already married, but, the lady who was taking my case, told me that she can issue me my ssn but with my maiden name, cause that was the name in my passport and I94. (remember that only valid ID is the passport until you get the EAD or GC). So she Gave me the option to wait for my EAD (I filled my entire AoS with my new name) so I can get a permanent EAD with my new name. Remember, if you get your ssn without the ead or gc, is a "provisional" ssn and then you will need to go back and change it. That's what I did, I wait so I dont need to be changing my documents all over again because of my name. It was my experience and it went good :).

Oh that's brilliant - thanks for the links.

Do I still have to apply for a social security number if I have had one before whilst working in the States on a J1 visa?

No. Your SSN is yours for life :-)
