Hi all,

My girlfriend (US Citizen) has filed an I-129F petition for me (German citizen) (NOA1 date June 20, 2012 from California Service Center, so we're hoping for an approval pretty soon).

Now the problem is that my fiance is attending university at the moment, so she does not have sufficient income as required for the affidavit of support. Even though I get along with her family very well, I would try to avoid asking her parents or other relatives to be a joint sponsor.

I have sufficient savings to support myself and my fiancee (assets of more than $100K). Does anyone know if this can be taken into consideration when applying for the K-1 visa here in Germany, or will I still need to present an affidavit of support?

Typically your assets are not considered when pursuing a fiance visa. Get married, and petition for a spouse visa, then your assets would be available to satisfy the I=864 affidavit of support.

That being said, the interviewing officer at the embassy is the one that makes the decision. Your USC fiance may want to contact the embassy to ask if it may be possible.

Contact the consulate directly and ask them if the beneficiary can use their liquid assets to self-sponsor and satisfy the financial requirements. If they will not allow that in Germany, then she will need to find a co-sponsor for the I-134(non-binding). Once you are in the US, married and filing for adjustment of status, your savings can be used on the I-864(binding contract).
