My partner in the US currently, and has been for the past 12 months, working pretty intermittently. In September last year he left a job he had been in for 3 years to return to his home town to help care for his Grandparents. He has just applied for a fantastic job, in fact his dream job, with regular full time hours, good pay and benefits. I am worried that when it comes to the I-134, it won't look good that he has only just started the job, in fact the start date isn't until October 1st. We have received our NOA2 and the Embassy in Sydney has our Petition and I sent the DS-230 last week. Our petition expires in the first week of December. I have booked my medical for the 9th of October, so we have everything we need to submit, but I am worried that his Affidavit will not be sufficient. Is it likely that we will be approved if he can show that he has had stability of employment in the past 3 or 4 years, that he has a good job now and if they will accept it, that I have evidence of savings and an income that will more than support me for over a year?

We have searched our brains to think of someone to be a co sponsor, but his family doesn't support our marriage. They are very religious, from the Bible belt of Southern USA, and already believe that he has sinned by being divorced once, and they frown upon him remarrying and we don't have any friends who are financially in a position to help....Alaska requires us to meet an income of $42,212 as I have 3 children, which is crazy because as a single Mum I have supported my family for a lot less than this for the past 5 years.

I am just praying that the person that interviews me will be having a good day and feel like giving someone a break and making our dreams come true.

Has anyone out there been in a similar situation, is there a requirement that the Sponsor be in their job for a specific length of time?

I've read here that you fell short that you could support the difference with 3x of your savings. Say you're short of $5k then you'll need at least $15k of savings. Just wait for the other knowledgeable members to response to your question. Good luck!

The requirements are higher for Alaska and Hawaii because the cost of living in those states is higher. If he meets the requirement with his new job, then perhaps you can ask the consulate to extend your petition and go for your interview after he has a few pay stubs from the new job. That way he can provide a letter from his new employer stating his salary and show a few pay stubs. As was mentioned above, assets can also be used at 3 times the amount you are short on income.

If he doesn't meet the requirement, he will need to try and find a co-sponsor. It can be any USC or LPR living anywhere in the US. His other option is to get a second job that will get him to the 125% requirement level.
