I filed my I-130 form for spouse immigration to US on March 2012. Right now i am about to file form for AOS & DS 3032. i already paid all the fees for both the forms. Now i came to know that there is a birth date discrepancies in my spouse birth certificate and other legal documents (i.e passport, school leaving certificate etc.) the birth certificate has a date of October 17th. while all other legal documents has birth date of July 17. Now, while preparing for the civil documents submission to NVC along with form DS 3032, i came to know that i have to submit original birth certificate of my spouse along with her other documents. I have already submitted her passport (which shows a birth date of July 17th.)and now i have to submit her original birth certificate (which shows a birth date of October 17).

Please help me what to do. Is there any legal procedure that I can follow so that the NVC wont make any objection on birth date discrepancies?? Is NVC or Mumbai Immigration Office really do background check on all original submitted documents (i.e birth certificate, passport, school leaving certificate etc.)

It would definitely raise questions if you submit the birth cert with a different date.

Do you know which date is correct and why/ when it was changed? The easiest would be to get the birth cert ammended.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree get the date changed in the birth certificate.

USCIS:

12/06/2011 - Married

01/17/2012 - I-130 Sent

01/18/2012 - NOA1 Date

07/30/2012 - NOA2 Email Received (194 Days since NOA1)

NVC:

07/30/2012 - Case arrived at NVC building

08/20/2012 - Received case #, IIN, gave both e-mail addresses

08/20/2012 - E-mailed DS-3032 (used email template & also attached scanned copy)

08/27/2012 - AOS bill invoiced & PAID online

08/28/2012 - AOS bill appears as PAID

08/29/2012 - DS-3032 accepted

08/30/2012 - IV bill invoiced & PAID online

08/31/2012 - IV bill appears as PAID

08/31/2012 - AOS Package sent (via priority mail)

08/31/2012 - IV Package sent (via priority mail)

09/04/2012 - NVC received both packets (due to weekend & labor day holiday)

09/11/2012 - AOS/I-864 accepted

09/17/2012 - RFE for DS-230 ques 30

09/19/2012 - Mailed new DS-230 by overnight mail

09/21/2012 - New DS-230 delivered at NVC

10/01/2012 - IV Package accepted

10/01/2012 - Case Complete

10/02/2012 - Interview date assigned by email

Mumbai Consulate:

10/05/2012 - Medical Done (Got the report on same day)

11/07/2012 - Interview @ Mumbai Consulate (Result: APPROVED)

11/09/2012 - Passport Pick up

11/22/2012 - POE Atlanta

Well actually the real birth date is 10/17 which is on birth certificate. but her birthdate was changed during her primary school admission in India (to save her one year earlier as admission cut off date in India ends in june. ) Now problem is I came to know this when I already submitted her passport (which has 07/17 as her b'day) copy to NVC. So if I submit her birth certificate, they will see different birth date.

I heard that if I submit an affidavit with her moms signature that her b'day is on 07/17 . They will accept it as alternative to birth certificate.

Plz help what to.

If I go with actual birth certificate, I have to change all her documents (I.e passport, school leaving certificate etc) and it will take lot of time to chand all this docs.

We already went to change the birthdate to municipal office, but they told that the date cannot be changed as it's official govt record and that it can't be wrong.

An affidavit with her parent for dob is accepted if her birth was never registered. But her birth was registered legally.

Parent made the mistake, and now she has to face all these trouble.

Yeah. thats true. but now how can I fix this situation. is there any way? I cannot submit other documents without this issue being resolved.

If you have an attorney for your case, then ask them for legal advice. Else hire an attorney for phone consultant. This is a very serious issue.

If one lie to USCIS for birth-certificate, then it is a trouble there. If you bring the actual birth-certificate, then there is alot of mess, but ultimately this solution can be better. Birth-certificate is a very important, it is a proof of one's citizenship.

Agreed with "iwaiting" This is a serious issue... Don't submit anything till you got the birth certificate fixed.

The best option is re-register the birth with the office with 7/17 date... Don't change the original DOB with legal documents

My wife tried to change the date in birth certificate to 17th July but the government officials strictly deny to change the date in birth certificate. However, while searching online on this issue, i came to know that if there is discrepancy in birth certificate regarding birth date, birth place or name, one should submit 2 affidavits from the relatives of parents. the affidavit should state that they were present during the birth of my wife and that her original birth date is 17th July. is that true? Can I go with this option? Please comment.
