My fiance and i have a daughter together She was born in the Us and has Dual citizenship. I am applying for the K1 visa and i know i do not need to file the K3 for her because of her US citizenship.

we just recieved our NOA2 and i am preparing documents for packet 3 coming soon.

for the DS-230, it says to fill out 1 per person including children, do i need to fill this out for my daughter? i have written everywhere else that she will be entering the US with me. so i guess it wont hurt if i fill this out for her too. just wondering if all this is required of me to do since she is a US citizen.

Your daughter does not need to file a DS-230 for an immigrant visa because she is a US citizen.

A US citizen only needs her US passport to enter the US and live there.

Technically, your US citizen daughter is not immigrating to the US. She is simply returning home. She is not an immigrant.

Filing the DS-230 for your US citizen daughter would be a waste of money. A US visa cannot be issue to a US citizen, so the DS-230 for your daughter would be denied and you will lose the fee.

If the question of "who is immigrating with you?" comes up, you do not include your daughter.

Ok great thanks for the precise answer. I will have to redo everything now!! Good thing I thought of this last minute!!

So Question 29 asks for names of all children so obviously she will be included there

Then question 31a asks who will accompany me to the US... I can just say N/A ??

I'll leave your question for someone else with more experience to answer, but I did want to say that is a lovely photograph of the three of you in your avatar. Your daughter is a real sweetheart!

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Yes that is what you do. I have a dual citizen child (born in Canada. Did his born abroad paper work, so his dad passed down his U.S. citizenship). For question 31a I just put none.

Life is like a roller coaster. Hold on tight and enjoy the ride!
