Hello all my friend out there. i need ur help. anyone can help me give me some idea i would appreciate and thank u so much. here it is :

i file form I 130 in 2009 to petition my wife in CAMBOIDA I got married in 2009 i got citizen in 2011 everything go process more than 2 years and my wife just got interview on june 5 2012 but fail the officer said YOUR MARRIAGE NOT GENIUS they can not issue the visa for her.they gonna send my case back to USCIS they told me to go back to USA and wait about 1, 3 month to get the notice from USCIS. till now i haven't receive anything yet.

-Do i have a chance to appeal my case ?

one day to one day keep thinking what i have to do and what is the notice from USCIS, can i appeal, how long can my wife come to USA to live with me we married this year is three years i went to visit her only two time first time got married second this year joint the interview with her hope when we go to interview together maybe have alot of chance to get visa but result is not is negative. please give me some ideas through ur experience. sorry my text a little bit jumble every time when i think about all this i always shock nervous and cry.

There are easy no answer. US embassy in PHP are now more suspicious to fake marriages. Unfortuunately the fake one are getting away with it, while the real true marriage are left with broken heart and asking why?

From what you said,I think the CO believed that that you hired someone for yourself to get a visa and then citizenship. Then you went back to get your wife. Also, only going back to PHP twice, once to get married and 2nd time to interview is not enough,considering a three year gap. You should have filed a k1,at least then you'd have a second chance on a CR1 to prove a bonafied marriage.

There isn't much you can do but wait.. I don't have an answer but I do feel your pain. NVC will let the petition expire.. You need to established stronger relationship, such as having a baby. There will be genetic test, it will take longer..but it's better than not having any chance at all.

When USCIS receives the file with the notes from the Embassy, they will do one of two things:

  1. Reaffirm their original approval of the petition and send it back to the Embassy for another interview, no action would be needed on your part. Note that this is a highly unlikely scenario
  2. Or USCIS will do the more likely scenario and that is send you a Notice of Intent to Revoke (NOIR). An NOIR will state specific reasons as to why the notice was sent.

An NOIR will state the specific reason or reasons as to why it is being sent. When sending your response, you must address each of those reasons. You also must respond to the notice by the stated deadline. Failure to respond by the stated deadline will result in your petition approval being revoked; failure to properly address the reasons in the NOIR will also likely result in your petition approval being revoked.

Once USCIS receives your NOIR response, they will review your submission and make a decision, reaffirm or revoke. It's important to note that a proper response does not guarantee reaffirmation. If the petition approval is ultimately revoked, you will then have to go through the appeals process.

It's also important to note that petition reaffirmation does not guarantee a visa will be issued, the petition will be returned to the Embassy and another interview will take place.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

December 9, 2025:  N-400 interview - approved

Whether you should appeal or try again is difficult to say, can you tell us more about your case?

Marrying on the first visit (a lady from your home country, maybe your home village?) is definitely a red flag, as it visiting only twice in 3 years. Were there any other issues? For example are you related, how were you introduced? How did you get your citizenship? Recent divorce or previous petitions for either of you? Any questions she couldn;t answer or answered wrongly at the interview?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

i know her in 2008 on my birth day in the time she call to her friend. she make me laugh in my birth day make me happy in my birth day that it never happen to me since i was born my mom never care about birth day dinner my dad pass away since i was young.i live with grandmom. just on the phone like that ready i imagine how about if we stay live together how happy i gonna have. 2009 i decide go to see her and got married. when i came back USA i ask lawyer agent to file I 130. after married i keep sending money to her every month. at the interview we did bring money sending receipt too. at interview we answer some wrong name cause we nervous. my wife don't know my brother's son name i told them even i am uncle them i don't know too. they ask my wife's brother name i answer her father's name. i think fake married it not took 3 year like that and i married with her for 3 year and i want kids too but i am scared it gonna make the case more harder cause it must need the sponsor. i plan when she here we gonna have kids. i am sorry a little bit long. any way thank you so much for ur time to read reply to me god bless you .
