Hi VJ! I'm selected for DV2013 . i live in US by working visa . one lawyer told me i don't need to send any forms to Kentucky to get visa(because i already has working visa) and no need to submit forms like DS( i saw DS-120 and other DSP? somewhere here)just watch numbers on travel.state.gov and look for your number ?! im confused about what he said , do i have to do something next , or just sit and wait any correspondence from uscis till October. i don't know what i have do next , i just have confirmation page? Please help me with advice .Thank you !

You can adjust status from within the USA, but you will still need to correspond with Kentucky I think- they don;t know what you want to do, and will not correspond with you unless you tell them you want to go ahead, they are not mind readers.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you Pengiun-ie , is there any chance do u know where i can find those forms that i need to sent to kentucky . today i called kentucky but it was helpless, they said u can submit DS230 but not necessary ?! also they said some numbers never appear on bulletin ?! so selection doesn't mean anything .

Yes it is true- if your selectee number is very high, there is a chance you will not get an interview for AOS.

If you are changing your status from US, you don't need to send anything to KCC. You will need to deal with USCIS and file i-485.

You have a link in the winning letter where is pointed out what is the process and what forms you need. Here is the link again.

If you have a big number >20,000 (depending on which region you applied in), AOS may not be right for you since it will take at least 4 months to process once your number is current in the visa bulletin.

also my i94 will expire in one month .

there is no link on my winning letter , no forms ! my#is 2013EURO...12000

u said AOS may not be right for me , so what i have to do then?

one lawyer said i need to start any step in october2012 NOT before. so i wait now month October 1.

some people said u need act immediately to be first 50.000 and others said wait for October !!!

If your case number is 12000, among other things, you have to check the visa bulletin, to see when your number will be current (according to the world region you are from).

The interviews are starting in October.

You can check this month's visa bulletin:

And see what numers are predicted to be interviewed in October.

Some of the winners with low case numbers (and who applied from their countries and sent all the required papers to KCC) already got e-mails with the date of their interview.

I don't know how the process looks like when you're already in the US.

@Asia i checked visa bulettin site but there is NO numbers ! only says Europe is Current , also cut off Europe 5,700.

when i clicked to Europe it doesn't do anything .

the main problem i don't know how to apply from here(US ).some people says send forms (DS122)with $330 fee to Kentucky some says its not necessary just apply for I485 !im not sure what to do now ?

Europe is current for DV-2012.

Cut off for October (for Europe) will be 5,700 (and this will be DV-2013).

That means that all applicants with case number below 5,700 (and who were positively verified by KCC) should be interviewed in October.

You could read these links to give you more information about Adjustment of Status. Here are links to the websites of the State Department and USCIS where Adjustment of Status is explained.

Here is a link to form I-485. Read the I-485 instructions carefully too.

In Part 2 of Form I-485 you tick "H" for "Other basis of Eligibility" and write "Diversity Visa Lottery Winner" in the space provided. You file this with the USCIS Chicago Lockbox facility. It's all there in the instructions of I-485

You might not be eligible for AOS because if your number is not current in November, you can't apply for AOS. If your status expires before you have applied for AOS then you become illegal and your AOS will be denied. The cut off number for November will be listed in October 2012 visa bulletin which come out on or about September 10th. Check it and if your number is still not current, send the forms to KCC, go to your country and wait for interview there.

You can't apply directly for AOS. You need to wait for your number to become current. For example, if your number becomes current in November, you can apply for AOS on Novmber 1st, not before that.

Thank you Maggiep ! To make sure ,is it my number not current next month (October)??? and who knows about November:)what's my chance if my number will ever available? i have 5 yrs visa ,only i94 will expire next month but i can come back i think .
