Do students pay taxes?

Hey there...

so I have a question regarding paying taxes: When I was an Au pair from 2009 - 2011 I did file taxes because I worked. I then changed my status during 2011 and only got money from my sponsor. My sponsor is paying insurance and tuition. On top of that I am getting around $500 - $700 a month just for my personal entertainment and to pay books and gas. I also paid some extra classes with that money (my sponsor pays for 12 units, I pay the rest). Everything was stated on the sponsor form they filed out, when I applied for CoS.

Now I wanna know if that money is taxable or if it's not, since I am not working for it and it is considered a gift. I will file AoS soon and just want to make sure that I didn't do anything wrong.

Day 00 - 01/02/2013 sent AOS package via USPS

Day 02 - 01/04/2013 package arrived in the am *patiently waiting for more*

Day 05 - 01/07/2013 received text messages for all 4 forms

Day 06 - 01/08/2013 checks been cashed

Day 08 - 01/10/2013 received NOAs for all four forms

Day 12 - 01/14/2013 received appointment letter for biometrics on 02/01/2013 but completed biometrics the same day

Day 27 - 01/29/2013 received email that our case is ready to be scheduled for an Interview :)

Day 29 - 01/31/2013 received an email that our Interview will be on March 6 2013!!!!!!!!!

Day 33 - 02/04/2013 received hardcopy of interview letter

Day 62 - 03/05/2013 EAD/AP approved

Day 63 - 03/06/2013 scheduled interview appointment - APPROVED

Day 66 - 03/09/2013 I130 & I485 Approval noitces arrived in the mail

Day 70 - 03/13/2013 EAD/ AP combo card arrives in the mail

Day 71 - 03/14/2013 Greencard arrives yay!!!

Yes it is "taxable" meaning you have to file a tax return and list it as income. It is doubtful you would actually PAY any tax due to the standard deduction and other credits but you need to fill out the papers and do the math, then send it in.

You need to answer 2 questions

1. Is the payment in cash?

2. Is your sponsor claiming you as an expense, for example is your sponsor deductiong from their taxes the money they pay you?

IF they are not deducting your expnses from their taxes AND they are paying you in cash, the whole thing can easily be forgotten. Oops.

No they talked to their tax guy and he said they can't deduct me from their taxes since its a gift, not like a salary or donation! I get the money wired to my account but since I'm moving soon, I gotta close the bank account bc there's no branch in CA... But I'm currently paying wedding stuff with that money also and wanna show statements of our joint bank accounts. They'll see that money goes in from VA and CA etc. so I really have to file? I mean it's a gift...

Yes. There are taxes on gifts also, however there is an exemption up to a specified amount. It is still necessary to file and do the math. Filing is NOT the same as PAYING. Plan to file a tax return and keep records of everything. Yu will likely not PAY any tax, depends on the amounts and your deductions.

Ok so I did file for 2011 and paid like $300 because I was an Au pair from Jan to August of that year. I then was in pending status and didn't receive any money until I started school in January 2012 ( I just lived there for free). So basically I have to file taxes for 2012. Do I include tuition also when I file?

Moreover: I am getting married Nov 30th of this year, does that mean my then husband and I have to file together? Or would I just file my NR EZ 1040 by myself?

F-1 students are obligated to file taxes regardless of whether they earned a penny or not during the tax year. You ALWAYS have to file. When you file, you have to declare all the income you've made - and my understanding is that these "gifts" would still have to be declared. Chances are the amount is so small that you won't be taxed on it, but you'll still have to declare it.

If your status is married by 31 December 2012, you will file as married. You can either file as "married filing jointly" or "married filing separately".
