Hello !

Was hoping someone might be able to assist. I'm a US Citizen, my fiance is Northern Irish/British National with an Irish passport as well. Our 129F has been approved by USCIS however we've decided that we'll live in the UK and will do so by obtaiing an EEA Family Permit. We applied for the 129F using his British passport information.

Does anyone know how long it takes for the London Embassy to cancel the 129F so that my fiance can travel here to the US on a visitor visa -without incident from Immigration upon arrival in the US ?

Or - is it better for him to travel from Dublin to the USA using his Irish passport ?

Any advise would be greatly appreciated. We've been together 7 years but apart for the past 3 so we are looking forward to finally being together in the same country

Doesn't guarantee his entry. They may think that you are up to something different.

You will have to prove to CBP that there are no intentions on staying and that he is leaving.

You can cancel the petition by sending a letter to the USCIS. If your case was already sent through NVC to the consulate, then you may want to send a duplicate letter to the consulate letting them know you no longer wish to pursue the K-1 visa and would like to withdraw your petition. I have read that you could get a confirmation of cancelling within a few weeks, but I really have no idea how long it takes them to confirm it. Traveling should not be issue at all, especially since no visa was ever applied for or received. Will go through customs as a visitor like always.
