Hello All,

I am planning for a concurrent filing. For the I-864 affidavit of support, the sponsor has to submit the last three years of tax return documents. Could someone please tell me what is the purpose of this? The income of my spouse (who is a grad student) is above 125 percent of US guidelines for two people household for the years 2010 and 2011, but not in 2009. Will this be a problem?

I am also earning as a grad student for the last four to five years, but according to the instructions it says "If certain conditions are met, the intending immigrant's income can help meet the income requirements." Though I don't need to put my income to meet the requirement, is there any way I can show that I am also earning?

I appreciate your suggestions.

The purpose is because the I-864 requires that tax returns be filed for the most recent 3 years. What better way to prove that you've filed than by producing the tax transcript?

Current and continuing income is what is most important. 2009 won't matter.

The purpose is because the I-864 requires that tax returns be filed for the most recent 3 years. What better way to prove that you've filed than by producing the tax transcript?

Current and continuing income is what is most important. 2009 won't matter.

You can add your income to the I-864 if you want. That goes on line 24.

If your spouse makes enough money, why bother putting your income on there? I say, simplify whenever possible.

Have you looked at the I-864ez form? If you qualify to use it, you might find it easier. And you only have to send the most recent tax return with that one, the others are optional. We used the I-864ez and had no issues. Just a thought...

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

Related to tax return, can we send only the recent only 2011 tax return or we have to have 3 years tax return?

If your spouse makes enough money, why bother putting your income on there? I say, simplify whenever possible.

Have you looked at the I-864ez form? If you qualify to use it, you might find it easier. And you only have to send the most recent tax return with that one, the others are optional. We used the I-864ez and had no issues. Just a thought...
