Hello

I am new to visa journey. I am living with my boyfriend and we have a baby together. I am living through hell right now as he traumatizes me, and I don't know what to do because of the baby. I want to file for VAWA,but he's got a complicated past, as he was married with a US citizen who abused him during their marriage. He then got a divorce from her and applied for VAWA himself and got his green card, but now he became the abuser with me.

Do I have chances when my case is so complicated?

This is a classic pattern for peopel in abusive relationships that do not get themeselves fixed before they jump into another one.

Anyways, you don't have any more complicated of a VAWA case than any other.

If you are truly being abused, and I don't doubt that youa re, you should seek help yesterday and take actions to better your position regardless of VAWA or not even if it means going back home.

first of all you need to have proof of the abuse. If you fear for you life go the police station and file a police report ,go to the court and get a restraining order.Find a shelter for victims of domestic violence and stay there. They will help you with lawyers, psychologist. Is he just a green card holder? you still can have your Vawa approved, but you won't be able to adjust your status soon because you will need a visa number becomes available for you,it will take a few years, but you will be able to stay in the USA, but DO NOT TRAVEL ABROAD not even with Vawa approved.

If you are victim of mental abuse you still can file Vawa, its bit complicated but you can do it. Find some help.If you want to send me a PM and I can give you more informations.He was abused and now he is repeating the same behavior he endured, its disgusting to say the least.Nobody deserves to be battered. Seek a safe place and get out.Good luck.

You state that you are having problems with your boyfriend. What is the immigration status you want to resolve with a VAWA?
