Adjustment of status for spouse?

Timeline

My sister and her husband are married for only 7 months. The petition is still is process, she just submitted her affidavit of support yesterday. Anyway my sister read something about adjustment of status and that the petitioner should call NVC or USCIS about it. Does the adjustment of status required for my brother in law?

What type of Petition did she File? I will assume it was the I-130? if so the AOS would be filed after the Visa is Received, and she must be here for 2 years..

So your sister and her husband are both here in the US? You say she submitted the Affidavit of support? I'm confused as to what is being filed and what stage they are at. That would help and if hey are filling and they both are here or what. I assume the husband is the beneficiary?

And is your sister a USC or LPR?

Her husband is still in the Philippines. My sister is a USC. The petition is still ongoing, my sister just submitted the affidavit of support yesterday.

Timeline

She filed the petition for the CR-1. Once the petition is complete it will be sent to the embassy, interview and other stuff to be scheduled. Once he receives the visa and arrives in the US he will be sent his green card and social security card, if they requested one, within a few weeks of arrival at the address given on the petition. No adjustment of status filing is required. Two years later, less 90 days, if he has a conditional green card he will need to file to remove conditions.

So her petition has been approved at USCIS and now she's at NVC doing the Affidavit of support documents and than the IV Bill documents.

No her husband will not be doing a Adjustment of Status.Thats for couples who filed here from like a visitor Visa, Tourist Visa or K1 visa. 2 years from his POE (Port of entry or arrival date) well 90 days before that 2 years they will do a ROC (removal of conditions) since they are married less than 2 years at the time the visa will be issued.

So again its a ROC (removal of conditions) not an Adjustment of Status that they will do 2 years from the date of arrival. He will move from a 3 year green card to a 10 year green card.
