Hi

I entered US on L1 Visa in 2009. My Visa has expired but my I94 is valid till 2013.

Now, I got married in June 2012 and applied for I130, I485 (AOS) and I765(EAD) in July.

I got my biometrics done and my EAD was approved. The card is on its way!

Question: My AOS is still under review but I should have EAD card with me in 15-20 days. Since I am on L1 Visa, do I have to continue working for my employer or can I look for another job based on EAD card?

Please advise.

Thanks,

MG

Yes, with EAD you can look for a new job. It is my understanding that once you use your EAD for a job, the L1 becomes null and void.

Read here, especially the first section.

Good Luck

I have to admit I'm confused by your post. If your L1 visa has already expired before your EAD arrives, then surely you shouldn't be working for your employer any more, even if the I-94 allows you to remain in the US?

Visa is only required to enter the country. What really gives you status is I94 and one can work till the expiration date of I94 regardless of visa validity..

Of course, if your visa is expired and then you leave the country (that's when you give away the I94), you cannot enter back until you renew the expired visa or get a new visa..

Thanks Harpa and Que for the information.

MG
