I got married 7/14 and I am working on getting my Cr1 packet ready. I do have a question about the evidence for a bonafied marriage.

i do plan to have my brother, a friend , pastor, and her brother sign an affidavit but I wanted to get your opinion about the template.

Does it matter if the verbiage for the template is similar to each one (other than obviously the name, address..etc personal info that each one will have)?

or should I request that each person write their own ? Any thoughts or recommendations would be appreciated.

Day 12/20/ went to do biometrics, turn away as wife has a cut on thumb - will try to walk in next week

Day 12/28 - bio metrics done ! - walked in San Diego as we were visiting my in laws.

Day 1/4/2013 - received text/email that case is ready to be scheduled for interview !

Day 1/15/2013 - received hard copy letter to let us know interview is on 2/12 !

Day 1/17/2013 - received text/email that EAD has been approved

Day 1/26/2013 - received EAD card

Day 2/12 - interview done - approved on spot!

Yes it matters. In most cases affidavits are lame and not needed. Please complete your profile with country etc. so we can give you better answers.

The affidavits I sent with my petition were different. I read somewhere that the affidavit signers are supposed to tell about what they know about the relationship and why the believe it's real. Identical verbiage won't seem very authentic. For example, one could say they went out on double dates with you two. Another one could say they witnessed him presenting her with certain presents or flowers, etc. I also read that affidavits signed by US citizens are more valuable.

18AUG2012 NOA1, rcvd SMS & email saying case is routed to Vermont Service Center, later rcvd by snail mail
21AUG2012 the date on next I-797C received only by snail mail, says petition transferred to Lee's Summit,MO
28AUG2012 "touch" (website shows case was updated)
03OCT2012 the date casefile was sent to Atlanta, per phone call with ISO
01FEB2013 infopass at Atlanta, casefile has not even been assigned to anyone yet!

21JUN2013 NOA2, email received! USCIS website is updated! No SMS was received.

Letter rcvd later by snail mail from NBC, Lee's Summit, MO; however, I know file was adjudicated in Atlanta.

NVC:

11JUL2013 the date NVC says they received our file

19JUL2013 called and got Case # and IIN #, gave email addresses

22JUL2013 received DS-3032 and AOS invoice by email, mailed DS-3032

The affidavits I sent with my petition were different. I read somewhere that the affidavit signers are supposed to tell about what they know about the relationship and why the believe it's real. Both assertions above are valid. For Ivory Coast, if you DO have people familiar with the actual relationship rather than just having attended a ceremony and/or party, two or three affidavits could be helpful. If they just attended your wedding or reception and/or it's not a high fraud area, there's no point in pursuing them, IMO. That's why I asked the OP to complete their profile to include the country.

To file with the Embassy Directly, she must have been living there for at least six months. If you've been living together in Jordan that long, I wouldn't bother with any affidavits.

For Jordan, and DCF evidence of the time you've spent living together THERE as husband and wife will be the most important. To file with the Embassy Directly, she must have been living there for at least six months. If you've been living together in Jordan that long, I wouldn't bother with any affidavits.

We just got married in July and we've been living to gether in the US as she entered on a tourist visa to see me for 6 months. her visa ends in January so she'll be interviewing in Jordan as she'll be heading back home to wait for the immigration visa.

since the affidavits aren't crutial and don't weight much i probably won't do them unless it really helps. I have marriage certs, skype logs, bank account reference letter of joint account, credit card joint card, pictures from trips...etc so i think i am good as this is the typical stuff i am seeing that i need to submit.

I see. In that case, unless she has a pressing need to return to Jordan in the next few months, why don't you just adjust her status instead of pursuing an immigrant spouse visa?

well she entered the US knowing that she will be immigrating ...wouldn't that be fraud? plus if she adjust status would her AOS be even done by january? I always thought its illegal to immigrate on a tourist visa if you have intentions to immigrate thats why we are not adjusting the status. She told CBP that she will return to Jordan to interview and finish paperwork there.

well she entered the US knowing that she will be immigrating ...wouldn't that be fraud? plus if she adjust status would her AOS be even done by january? I always thought its illegal to immigrate on a tourist visa if you have intentions to immigrate thats why we are not adjusting the status. She told CBP that she will return to Jordan to interview and finish paperwork there.

So, she clearly told the truth upon entry. If your plans change, they change. If you file now, sure, she'll have at least advance parole and EAD before January but it doesn't matter unless SHE has a need to leave then. When adjusting status based on marriage to a US Citizen, overstays are forgiven.

Lot's of folks here who didn't have the option you have, will tell you all sorts of things to try to guilt you out of selecting that viable option. Make your own choice. On the day of your AOS interview, you'll be one of hundreds that day whose spouses entered with B1B2 visas or on the VWP, married and adjusted status. It is what it is. I WISH that had been an option for us. It wasn't. No hard feelings.

Wow i am shocked that you are stating this as this has been what everyone has been advising against as being illegal from day one. Would we get in trouble if we try to adjust since that wasn't really our intention when she entered? since we told the cbp officer that shes returning? i am a bit hesitant as i don't want to go against rules but if this is an option ( a safe one) why not i guess but it goes against what i had planned 7 months ago heheh.

Plans change. Not "everybody" is telling you it's illegal but everybody who IS telling you it's illegal is "wrong".

so i called USCIS and talked to a representative. I played dumb and told them I just got married and what forms do i need to fill out to get my wife to be a permanent resident, she entered on a B1/B2 visa legally. She stated that as long as she entered legally she can file for I130 and I485 for ASO. I asked her several time if its 'OK' if she was out of status the rep said yes that is fine.
