Hi,

I am the non US, the one who is being petitioned for. If my wife (the petioner) enters the USA before I recieve my green card (CR1) can I enter alone? Also, does she have to attend the interview?

We currently are about to send the i-130 form.

If you require more information please ask. I am using other sponsor affidavits (i864).

Thank you

Paul

No, she doesn't have to attend the interview and yes, you can enter the US after her. You can't enter before her though.

It's not necessary for her to attend the interview. Be sure to read the instructions when sending off your petition to avoid RFE. You will not be receiving a green card to enter the US, but a visa in your passport good for 6 months to enter from when you are approved. You will receive the gc after your POE. You can enter US without your wife.

Yes. No. (In that order)

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
