My wife is a USC living in England on a student visa, and we are applying for the CR-1. We're putting together the i-130 package now, but we do not know which names to use.

I changed my name via deed poll for a double barrelled name, but neither of us have changed our ID yet. I know we will use our current legal names, but her Student visa is in her current passport with her maiden name. We are going over to the US on tuesday for a few weeks, could she change her passport name and still keep the student visa? Since the flights are booked in her maiden name, would she have a problem coming back to england with a new name on her passport?

The USC doesn't have to show passport at NVC either just the beneficiary.

And many of us have changed our names and passport or airline tickets were in maiden name (I had a new emergency passport when I was coming back from nigeria) I was told just in case keep marriage license handy in case airline at check-in had issue they didn't no problem ticket in maiden name passport in new married name.

But what ever her I'd states is the name she puts on application. And under other names she can put her new married name.

I'm lost as to who is the petitioner and who is the beneficiary. Please clarify for a meaningful answer.

It's a little different in our case though due to the student visa she has in her current passport with her maiden name. if they cancel this passport in order to issue another one, the student visa becomes invalid.

Then no need. Your marriage certificate will satisfy any need to document her current legal name. Sometime before the NVC stage of your process, get a passport in your current legal name. She can change her passport name whenever it becomes practical for her. Just bear in mind that any international travel tickets should be in the current passport name.
