Hi guys, I am kind worried recently. I concurrent filed my I-130, 485, 765 by June.27. I did my biometrics on July. 18. Right now my status still shows pending for all the three cases.

My questions are...

1. I didnt file the advance parole travel document, i thot it's no required and Im not planning to travel outside of the U.S. Is that ok not filing it?

2. I was under OPT F1, but it has been expired on July. 19, so what's my current status? I assume that I can only stay in the U.S. but i cant do anything, such as study or work unless i receive my EAD?

F1(OPT) to AOS:

2012.06.25 Sent Package

2012.06.27 Package delivered

2012.06.29 Emails/texts acceptance confirmation

2012.07.02 Checks been cashed

2012.07.06 I-797C 3 hard copies received.

2012.07.12 Biometrics Appointment received. Scheduled for July.18

2012.07.18 Biometrics Completed

2012.08.27 EAD Approved

2012.08.31 EAD Mailed out

2012.09.05 EAD received

2012.09.05 I-485 interview scheduled on Oct.10

2012.10.10 Interview day

1) No, AP is a benefit of filing, not a requirement.

2) Your official status is "pending adjustment of status". You cannot go outside the country without AP or you risk abandonment of your petition. You really shouldn't work without EAD, but others here have said it's forgiven for spouses filing for AOS...but I (personally) wouldn't risk it. You likely will get EAD soon and can do it legally. I think they are running around 80-90 days for approval on EAD currently.

Total elapsed time between filing I-129F to GC in hand 569 days or 1 Year, 6 months, 22 days.
