Hi.

Me (UK resident) and my fiance (US resident) are planning on getting married soon. He is coming over here on a Visitor For Marriage Visa so it will be happening here in the UK during his 3-4 week visit. The plan is to then apply for the CR1. The only problem is that I suffer from diagnosed severe anxiety, so whenever I am allowed to go over to the US as a Conditional US Resident he will have to fly back here so that I have someone to fly to America with. That isn't particularly a huge problem. The main problem is the processing time. With him working he won't be able to visit here during the process and because I can't fly alone I won't be able to visit him.

So my question is:

Is there any way for me to go back to the US with him on a 6 month Visitor Visa immediately after the marriage and apply for the CR1 while staying there? I have read that if I am in America while applying for an AOS then I can go over my 6 month visa expiration date; would this work on a CR1? I'm aware that there is an interview I would have to attend in my own country/(in London); is there any way due to the circumstances that my interview could take place in America? With my anxiety I would also struggle to go to the interview in London alone so my fiance being able to come to the interview with me would make everything so much easier.

The chances of you obtaining a tourist visa are next to nil. If you were able to obtain a tourist visa, your (soon to-be) US Citizen spouse could file the paperwork while you were in the country.

No, if you were to stay past your authorized stay, you would accrue overstay. If you overstay 180 days to 1 year and then leave the US to attend a visa interview in London, you will be subjected to a 3 year re-entry ban. If you overstay for 1 year or more and then leave the US to attend the visa interview, you would be subjected to a 10 year re-entry ban. A waiver would have to be filed in order to for you to be allowed re-entry before the time you are subjected to ban is over.

For a CR-1 visa, absolutely not.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

Two things:

- Did you check into the marriage laws in the UK? Special visas are needed to get married in the UK, he can;t just come on a visitors visa.

- In your case, a K1 fiance visa may be more suitable. With this, you do the via processing before the wedding, then when you have the visa he can come over to get you, fly to the USA, get married there and live together right away after the wedding. If you wish for a wedding celebration in the UK, you can do a blessing a few months after the wedding when you both travel back for a holiday.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you are a UK citizen, you can "visit" the USA for three months at a time without a visa but there is never a guarantee of entry. This is a tough process, that usually features some months of separation, so best to get your head around that.
