can you travel on a holiday visa whilst waiting for i130

I posted earlier and it sounds like trying to adjust status after a wedding on a tourist visa is a big no no, so i was wondering, if I marry in October, return home and we file form i130, can I still go visit him in the US while we wait for it to process? I would have a return ticket for sure... I just don't like the idea of going 6 -12 months without seeing him :(

It all depends on if you can show strong strong country ties. What country because it matters. Coming form UK or Canada may not be a big deal. And having a return tickets means nothing to the border agent. You have to show good reason ties to why you would return. And once married having a spouse in the US makes yoru ties stronger to the US.

In your other post you mentioned you had kids. Proof of their enrollment in an aussie school would help as well. When you travel try to bring as much evidence of your ties to AU as you can. Good luck!!

I-130 Approved in 11 weeks!!!:)
