hi guys, id like to ask.. based on my timeline if my K1 is already overdue? and if it is... then what should we do?

my fiance is so busy that i do not know if he's still interested in pursuing this case/petition.. :sad:

K1 Visa Timeline

02.02.06 - I-129F, sent to CSC

02.17.06 - NOA1 WAC#

06.10.06 - email received that Case transferred to MSC ??

06.23.06 - NOA1 - received a new case # from MSC

06.27.06 - IMBRA RFE from msc (thru email)

07.07.06 - Received / sent IMBRA RFE back to MSC (by mail)

08.14.06 - he sent me an email saying that he GOT HIS EX FILIPINA GF PREGNANT

10.03.06 - my birthday and WERE OVER

11.16.06 - NOA2 APPROVED (email)

02.12.07 - Packet received

03.27.07 - Medical Schedule (did not attend)

04.03.07 - Interview Schedule (did not attend)

JAN. 2007 - met somebody and became friends

FEB. 11.07 - His First Visit

FEB. 04.07 - Filed for Declaration of Nullity

MAR 21.07 - Copy of petition sent to Prosecurtors Office and Solicitor General

APR 17.07 - Court ordered lawyer to file a "writ of Publication" because the respondent lives abroad

MAY 7 & 15. 07 - publication was made

MAY 21.07 - Filed manifestation of completion to the court and send copies to OSG

JUNE 26. 07 - submitted Original copy of the Affidavit of Publication

Overdue is a relative term. You certainly have an unusual chain of events going to CSC then MSC and then back to CSC. I do not quite understand that one. One would have thought a Feb filing would have been adjudicated but there is nothing typical when dealing with these people.

Some thoughts:

1. A wait this long is totally unacceptable. I'd contact Members of Congress.

2. I don't understand what MSC has do with a K1 application. Perhaps NSC??

3. I think the issue of lack of care by your fiance is far more important than anything else. If that relationship is not strong, then why go through all of this??

Good luck in sorting it out. At least the two of you have more control over the most important, #3.

well, here's the story.

me and my fiance were married back here but the marriage considered null and void.

we file first k3 - i got denied when we found out that i have an exisiting marriage to my ex (which i never did).. so i have to go to the court. the judge decision that the marriage is fraud and illegal.

second k3 - i got denied, because they said that our marriage is considered null and void due the existence of marriage to the ex. the US Embassy Manila is not considering the fact that it was fraud and of course the date of the termination of the marriage to the ex and my marriage to my husband now fiance.

anyway. they suggested us to go through the K1 route.. my fiance was able to talk to 2 senior offices of the embassy and they told him the same... so we did.

that is the story of our K1. and im afraid that my fiance is getting tired of waiting for me.. actually, were having problems right now (third party)

so the k1 papers are my only hope so that he and i will be given a chance to be a family..

Well unfortunately, considering the background and previous petitions, it's not at all surprising that it is taking so long. Contacting a senator to make an inquiry *might* get you some additional information on the hold up but that's not 100%.
