Ok. So after our RFE request, I'm sure learning a lot about IMBRA. Theres a lifetime limit on K-1 visa apps, which is two. This is our second time applying.

God willing, we wont be denied again, but IF WE ARE, can we still get married & apply for a K-3? Or are we shut out of that too? Does anyone know? I'm really freaking out. I have no idea what I'd do if we were totally banned from living together (in this country at least..)

According to IMBRA, for i-129f you can ask for a waiver if it is more than 2 lifetime or Two petitions within a 2 year period.

IMBRA does not apply to spouse filings.

K-3 is obsolete now, you would be looking at the CR-1 spousal visa.

Im curious what was your RFE request for in relation to IMBRA? IMBRA may affect me also is why I am wondering. Thanks.

It is not a big deal to get over from this. We got the same and our petition was approved after few days of sending this waiver request.

Yes, a waiver for the 2 year period is simple especially if both petitions have same beneficiary. Someone else recently got waiver approved after filing 1 year 9 months for second beneficiary (1st one did not come to relationship). They just want keep records and database of multiple filers. If you file too many times, better to get married and go in a spouse to avoid the IMBRA restrictions.
