I am currently travelling the US on a B2 tourist visa. I hope to return home to the UK for a month before returning again for a couple of months under the visa waiver program.

I understand it's at the discression of the officer at the boarder, but any advice would be appreciated. Will a month be long enough away to be re-admitted as long as I can prove the usual things: intent to return home, ability to support yourself financially etc?

You can't move from a B2 to the VWP. If your B2 is multi-entry, they may let you back in though.

How long have you been in the US this time, and how many weeks have you been in the US since July 2011?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Why did you get a B2 in the first place?

I will have been in the US for 6 months by the time I leave. I am on the B2 for travelling. There is still more I want to see, so I was hoping to leave when my visa expires and return a month later under the VWP. Why is this not possible?

I have not been in the US at all prior to this trip within the last 2 years.

I'm not sure about the ESTA. I am a British citizen so I think I can fill out an ESTA no problem when hopefully returning to the US

Nobody is saying it is not possible, just that they may wonder where you are living and where you are visiting.

Nobody is saying it is not possible, just that they may wonder where you are living and where you are visiting.

Thanks Boiler. If I can prove I have a job waiting back in England, money to support myself, ties home etc do you think it's possible?

After all, if my intentions were to stay in America logic would say why return home at all? If i left within my time frame and followed all the rules i'd imagine I should be re-admitted. But I don't know the actual law or logistics of this - which is why i'm asking for your help.

There is no law, it is at their discretion to let you in.

It is possible, odds I would not like to say.

Is there any history of honest people getting sent home, who've paid for their flights, have a good case for being a 'legitimate' tourist with all the paper work etc? It seems that would be rather extreme, especially to a citizen under the VWP. I realise everything is up to the discretion of the person at the border though

"It is possible, odds I would not like to say." - is this suggestive of it being unlikely, or you just don't know?

You only hear usually from those who have been sent home, so inevitably when most are admitted it is self selecting.

To work out the odds for your case you would need to ascertain all the variables and have access to an appropriate data base.

Which is just not possible.
