I have been living in South Korea for over three years. Foolishly, I did not file my tax returns for 09,10,11 until last week. They are currently in the mail. After reviewing the intructions for the i-864 I noticed the following:

If you were required to file a Federal income tax return during any of the previous three tax years, but failed to do so, you must file any and all late returns with the IRS and attach an IRS-generated tax return transcript documenting your late filing before you can submit the I-864 Affidavit of support.

I understand that it could take months for this to process. Really stressed out right now. My father also filled out the I-864 as a joint sponsor. Will they reject our application on the grounds that my tax returns have not been officially filed??? Or will they default to my fathers tax records?

I was planning on submitting my I-864 with photo copies of the late tax returns that I just sent to the IRS. Now I'm not so sure.

This might be a stupid question, but will they verify with the IRS that my tax returns have, in fact, been filed?

I would simply submit a complete copy of each of the tax returns.

Don't feel bad Ocalmy. That is hardly a stupid question. I just fild my 2009 didn't know I had to heck I worked all of 7 weeks and owe. Who knew. S good you asked. Thank you
